Amaç: Bu çalışmayla akıl hastalığı bulunmayan, 12-14 yaş arası, suça sürüklenen çocuklar ile sürüklenmeyen çocuklar arasında; sosyodemografik özellikleri ve bir suçun hukuki anlam ve sonuçlarını algılamaları ile davranışlarını yönlendirme yetenekleri bakımından farklılıklar olup olmadığı belirlenerek, ceza sorumluluğu başlangıç yaşı ile bu yaş gurubunun hekimlerce yapılan ceza sorumluluğu değerlendirmelerini tartışmaya açmak amaçlanmıştır. Yöntem: Çalışmaya; Süleyman Demirel Üniversitesi Tıp Fakültesi Adli Tıp Anabilim Dalı Polikliniğine ceza sorumluluğu değerlendirilmesi için gönderilen 12 yaşını doldurmuş ancak 15 yaşını doldurmamış, akıl hastalığı bulunmayan 50 suça sürüklenen çocuk alınmıştır. Ayrıca çalışma grubu ile yaş ve cinsiyet açısından eşleştirilmiş 50 suça sürüklenmemiş çocuk ile kontrol grubu oluşturulmuştur. Katılımcılara "Sosyodemografik Veri Formu", dört senaryo üzerinden sorulan sorularla suçun hukuki anlam ve sonuçlarını algılayabilip algılayamadıklarını ölçmek üzere bir anket (Suçun Hukuki Anlam ve Sonuçlarını Algılayabilme Anketi), davranışlarını yönlendirme yeteneklerini belirlemek üzere dürtüselliklerini ortaya koyan "Barratt Dürtüsellik Ölçeği (BIS-11)" uygulandı. İstatistikler, Windows uyumlu bilgisayarda "SPSS for Windows 21.0 istatistik paket programı" kullanılarak yapıldı. Elde edilen veriler ise Student's t, Mann Whitney U, Wilcoxon Rank, Paired t ve Fisher's Exact testleri kullanılarak karşılaştırıldı. Bulgular: Her iki gruptaki çocukların suçun türüne, gerçekleşme şekline ve suça sürüklenen çocuğun telkine uğrayıp uğramadığına göre yanıtlarında değişiklikler olduğu görülmekle birlikte elde edilen verilere göre; - Hırsızlık suçu ile ilgili olarak, çalışma grubundaki çocukların % 60 ile % 84'ünün, kontrol grubundaki çocukların % 80 ile % 90'ının "fiilin hukuki anlam ve sonuçlarını algılayamadığı", - Yaralama suçu ile ilgili olarak, çalışma grubundaki çocukların % 76 ile % 86'sının, kontrol grubundaki çocukların % 94 ile % 96'sının "fiilin hukuki anlam ve sonuçlarını algılayamadığı", - Yağma suçu ile ilgili olarak, çalışma grubundaki çocukların % 66 ile % 86'sının, kontrol grubundaki çocukların % 82 ile % 92'sinin "fiilin hukuki anlam ve sonuçlarını algılayamadığı", - Cinsel istismar suçu ile ilgili olarak, çalışma grubundaki çocukların % 42 ile % 50'sinin kontrol grubundaki çocukların % 32 ile % 64'ünün "fiilin hukuki anlam ve sonuçlarını algılayamadığı", - Cinsel istismara yardım suçu ile ilgili olarak, çalışma grubundaki çocukların % 66 ile % 68'inin kontrol grubundaki çocukların % 50 ile % 74'ünün "fiilin hukuki anlam ve sonuçlarını algılayamadığı" saptandı. Barratt Dürtüsellik Ölçeği; toplam dürtüsellik, dikkatsel dürtüsellik, motor dürtüsellik, plansızlık dürtüselliği puanları açısından iki grup arasında istatistiksel olarak anlamlı fark bulunmadı. Ayrıca her iki gruptaki çocukların BIS-11 toplam ve alt ölçek puanlarının yaş gruplarına göre karşılaştırılmasına göre; 12, 13 ve 14 yaş için gruplar arasında toplam dürtüsellik, dikkatsel dürtüsellik, motor dürtüsellik, plansızlık dürtüselliği puanları açısından da istatistiksel olarak anlamlı fark bulunmadı. Tartışma: Bulgularımız literatürde belirtilen ergenlik döneminde beyinde meydana gelen nöroanatomik ve nörokimyasal değişimler nedeniyle hukuki muhakeme, karar verme, dürtü kontrolü gibi yeteneklerde eksiklik gösterdiği bilgisi ile uyumludur. 12 – 14 yaş grubu ergenlerin suça sürüklenmiş olsalar da olmasalar da kanunun suç olarak belirlediği eylemlerin hukuki anlam ve sonuçlarını algılamadıkları ve aynı zamanda bu eylemlerden kaçınma konusunda davranışlarını yönlendirme yeteneklerinin de henüz gelişmediğini ortaya koymuştur. Ancak hem söz konusu literatür bilgisinin hem de çalışmamızda saptanan bulguların aksine ülkemizde hekimlerin pratikte suça sürüklenen çocuklara oldukça yüksek oranlarda eylemin hukuki anlam ve sonuçlarını algıladıkları ve davranışlarını yönlendirme yeteneklerinin geliştiği yönünde rapor verdiği görülmektedir. Sonuç: 12 – 14 yaş grubu ergenlerin kanunun suç olarak belirlediği eylemlerin hukuki anlam ve sonuçlarını algılamadıkları ve aynı zamanda bu eylemlerden kaçınma konusunda davranışlarını yönlendirme yeteneklerinin de henüz gelişmediği ancak çocukların suça sürüklenmelerine çevresel ve sosyokültürel etkenlerin neden olduğu belirlenmiştir. Çocuklarda ceza sorumluluğu değerlendirme işleminin en az 14 yaşının bitirilmesinden itibaren başlatılmasına ilişkin yasal düzenleme yapılması gerekmektedir. Ancak beyindeki nöroanatomik gelişim özellikleri ve nörokimyasal değişimler göz önüne alındığında 15 - 17 yaş grubundaki çocuklarla ilgili de benzer çalışmalar yapılarak ceza sorumluluğu yaşının hangi düzeyden başlatılması gerektiği tartışılmalıdır.

Aim: The aim in this study was to determine whether there were any differences in the sociodemographical characteristics and their perceiving the legal meaning and results of a crime and the ability of routing behaviors among 12-14 year old children without any mental diseases who were and were not dragged into crime and to discuss the criminal responsibility beginning age and the evaluations of doctors on the criminal responsibility of this age group. Method: 50 children between the ages 12 and 15 who have no mental diseases and were dragged into crime were sent to Süleyman Demirel University Faculty of Medicine Forensic Medicine Department Policlinic for the evaluation of their criminal responsibility were included in the study. Also a control group of 50 children matched with the study group considering their ages and genders and who were not dragged into crime was formed. Participants were given "Sociodemographical Data Form", a questionnaire measuring their ability to sense the legal meaning and results of the crime with questions on four scenarios (Ability to Sense Legal Meaning and Results of a Crime Questionnaire) and "Barratt Impulsiveness Scale (BIS-11)" to demonstrate their impulsiveness in order to determine their ability of routing behaviors. Statistics were made using "SPSS for Windows 21.0 statistics package program" on a Windows compatible computer. The data acquired were compared using Student's t, Mann Whitney U, Wilcoxon Rank, Paired t and Fisher's Exact tests. Findings: Although differences were observed in the answers of children considering the crime type, occurence way and whether the child dragged into crime was infused or not in both groups, the data acquired showed that; In larceny offense, it was observed that 60 to 84% of the children in the study group and 80 to 90% of the children in the control group "couldn't perceive the legal meaning and results of the action", In injury offense, it was observed that 76 to 86% of the children in the study group and 94 to 96% of the children in the control group "couldn't perceive the legal meaning and results of the action", In plunder offense, it was observed that 66 to 86% of the children in the study group and 82 to 92% of the children in the control group "couldn't perceive the legal meaning and results of the action", In sexual abuse offense, it was observed that 42 to 50% of the children in the study group and 32 to 64% of the children in the control group "couldn't perceive the legal meaning and results of the action", In assistance to sexual abuse offense, it was determined that 66 to 68% of the children in the study group and 50 to 74% of the children in the control group "couldn't perceive the legal meaning and results of the action", A statistically significant difference was not found in total impulsiveness, attentional impulsiveness, motor impulsiveness, nonplanning impulsiveness scores obtained using Barratt Impulsiveness Scale. Also no statistically significant difference was found in total impulsiveness, attentional impulsivess, motor impulsiveness, nonplanning impulsiveness scores between the groups for the ages 12, 13 and 14 in the comparison of BIS-11 total and subscale scores of children in both groups. Discussion: Our findings are in line with the information in literature regarding the deficiency in abilities such as legal reasoning, decision-making, impulse control due to the neuroanatomical and neurochemical changes which take place in the brain in adolescence. It was revealed that whether they are dragged into crime or not, the adolescents in 12 - 14 age group didn't perceive the legal meaning and results of the actions determined as crime by the law and their ability to refrain from these behaviours and routing their behaviors had not developed yet. But on the contrary to both the information in literature and findings of our study, it is observed that the doctors in our country give reports to children who are dragged into crime in practice showing that they perceive the legal meaning and results of the action in rather high ratios and their ability to routing their behaviours have developed. Result: It was determined that adolescents in 12 -14 age group don't perceive the legal meaning and results of the actions determined as crime in the law and also their ability to refrain from these actions and routing their behaviors has not developed yet but environmental and sociocultural factors drag the children into crime. A legal regulation to start evaluating criminal responsibility in children over the age of 14 should be made. But when neuroanatomical development characteristics and neurochemical changes in the brain are considered, beginning age for criminal responsibility should be discussed by doing similar studies on the children in 15-17 age group.
