Tüm madencilik çalışmaları maden yasası ve ilgili yönetmelikleri ile düzenlenmektedir. Bir başka deyişle, madencilik sektörünün işleyişi ve gelişmişliği üzerinde maden yasası hükümlerinin çok büyük bir etkisi bulunmaktadır. Madencilik sektörünü canlandırmak amacıyla 1985 yılında 3213 Sayılı maden kanunu çıkarılmış, yasa 25.6.1987 tarihli Resmi Gazetede yayınlanarak yürürlüğe girmiştir. Bu yasa uzun yıllar boyunca yürürlükte kalmış ve madencilik çalışmalarını yönlendirmiştir. Bu yasanın güncel gereksinimlere cevap vermede yetersiz kalması nedeniyle 3.6.2004 tarihinde 5177 sayılı maden yasası Türkiye Büyük Millet Meclisince kabul edilmiştir. Resmi Gazetede yayınlanarak işlerlik kazanan yasa, 3213 sayılı yasanın değiştirilmiş bir biçimidir. Bu çalışma ile yasanın değiştirilme sebepleri ve bu sebeplerin meydana getirdiği sonuçlar değerlendirilmiştir. Yasa ile birlikte getirilmiş olan düzenlemeler araştırılmış, 5177 sayılı maden kanununun madencilik sektörü açısından olumlu ve olumsuz yönleri incelenmiştir. All the mining studies are arranged according to the mining law and its related regulations. In other words, the mining law and judgements have very important and huge effects on the processing and performance of mining sector. For improving the sector a new law has been formed in 1985 year and it was pressed to the official journal to make it precise in 25.6.1987. This law was in force for too many years and judged on mining works. Because of the law couldnt give response to the new expectations and needs of the growing sector, the 5177 numbered mining law have been formed in 3.6.2004 and accepted by the turkish grand nationals .By given to the offical journal the law started to work and this was a changed form of the 3213 numbered law. In this study, the changing reasons of mining law and the results of the new law was discussed. Moreover the arrangments for the new law shows the bads and the brides sides of the 5177 numbered law in mining world. Keywords: 3213 numbered mine law,5177 numbered mine law.
