Bu tezin amacı dolaylı vergiler içinde yer alan Özel Tüketim Vergisinin hem Türkiye ile Avrupa Birliği arasında ortaklık kuran Ankara Anlaşmasının ardından gelişen Avrupa Birliği sürecine uyum bakımından, hem de Türk Vergi Sisteminin daha etkin ve daha sade olması bakımından incelenmesidir. Özel Tüketim Vergisi konusu Türkiye'nin Avrupa Birliğine uyumu ile ilgili olarak 4760 sayılı kanun çerçevesinde değerlendirilmektedir. Bu kapsamda Türkiye'de Özel Tüketim Vergisi'yle yürürlükten kalkan çeşitli vergiler ile değişen vergi hasılatı üzerine inceleme yapılmıştır. Bu çalışmanın kapsamında ilk olarak Avrupa Birliği'yle ilişkiler çerçevesinde Türk Vergi Mevzuatında yapılması gereken çalışmalara yer verilmiştir. Ayrıca Avrupa Birliği'ne uyum bakımından Katma Protokolün imzalanmasıyla başlayan geçis dönemine ilişkin, 1 Ocak 1996 tarihinde Gümrük Birliği'nin yürürlüğe girmesiyle meydana gelen gelişmeler incelenmiştir. İkinci olarak vergi hasılatı icinde dolaylı vergi oranının giderek artması ve bu artışın yansıması olarak Özel Tüketim Vergisi'nin oluşturduğu etki üzerinde durulmuştur. Üçüncü olarak da vergi hasılatı içerisinde dolaylı vergi oranının artmasıyla vergi adaleti arasındaki ilişki ele alınmıştır. Sonuç olarak Avrupa Birliği'ne uyum çerçevesinde getirilmiş olan Özel Tüketim Vergisi'nin yapısı itibarıyla vergi gelirleri içinde hasılat yönünden önemli bir miktara ulaştığını ancak vergi adaleti bakımından olumsuz bir görünüm arz ettiğini söylemek mümkündür. The aim of this thesis is to examine the Excise taxing, which takes place in the indirect taxes in accordance with the European Union process which developed after the treaty that created a partnership between Turkey and the European Union and which was the Treaty of Ankara, and also to examine the Turkish Tax System in accordance with it to become more effective and simple. The topic of Excise tax is evaluated under the frame of Law No. 4760 in Turkey's accordance with the European Union. In this scope, the tax revenue, which has changed with some of the taxes loosing force because of excise taxes, has been examined. Firstly, within the scope of this research, the studies that must be carried out in the Turkish Tax Legislation in the frame of relations with the European Union have been covered. Furthermore, the developments which appeared with the Custom Union becoming effective on the January 1st, 1996, regarding the transition period that started with the Additional Protocol being signed in accordance with European Union have been examined. Secondly, the gradual increase of indirect tax rate in the tax revenue and, as a reflection of this increase, the impact derived from the excise tax have been emphasized. Thirdly, the relation between the increase of tax rate in the tax revenue and the principle of equity of taxation has been handled. As a consequence, it is possible to state that, regarding the form, the Excise Tax has reached to a significant amount in terms of income in the tax revenue and it presents a negative appearance in account of the equity of taxation.
