Görevi kötüye kullanma suçu 12.10.2004 tarihinde Resmi Gazetede (RG.) yayımlanan ve 01.06.2005 tarihinde yürürlüğe giren 5237 sayılı Yeni Türk Ceza Kanununun (YTCK) 257.maddesinde (m.) düzenlenmiş bulunmaktadır. Görevi kötüye kullanma suçu genel ve tamamlayıcı bir vasfa haizdir. Eski Türk Ceza Kanununda (ETCK) dört madde altında düzenlenen (212.m., 228.m., 230.m., 240.m.) bu suç tipi YTCK da tek bir madde ve tek bir başlık altında toplanmıştır. Bu sayede ETCK'da mevcut olan dağınıklığa son verilmiştir. Ayrıca ETCK'da yer alan 230.m. ve 240.m. ayrımı noktasında özel kastın gerekip gerekmediği konusundaki tartışmalar ortadan kalkmıştır. Bunun yanında yine ETCK'da yer alan 228.m. ve 240.maddenin aynı konuyu düzenlediği hususundaki tartışmalarda sona ermiştir. Bu çalışmada, YTCK'nın 257.maddesinin 1. Fıkrasında (f.) yer alan görevi kötüye kullanma suçunun icrai bir hareket ile işlenmesi kısmı irdelenecektir. İhmal, gecikme göstererek görevini kötüye kullanma, irtikap suçunu oluşturmadığı takdirde görevinin gereklerine uygun davranması için veya bu nedenle kişilerden kendisine veya bir başkasına çıkar sağlayan kamu görevlisinin durumunu düzenleyen 257.maddenin 2. ve 3. fıkraları bu çalışmanın kapsamı dışında yer alacaktır. Bunun nedeni, görevi kötüye kullanma suçu konusunda genel çalışmalar hem kitap hem de yüksek lisans tezi olarak bulunmaktadır. Ancak bu çalışmada özellikli olarak YTCK'nın 257/1. maddesine yer vererek daha dar kapsamlı fakat detaylı bir çalışma yapılması amaçlanmıştır. Ayrıca görevi kötüye kullanma suçu ile ilgili hiçbir çalışmada tam olarak yer almayan usul yönü de bir bütünlük içerisinde verilmiştir. Görevi kötüye kullanma suçunda suçun faili kamusal faaliyet icra eden kamu görevlisidir. Yeni kanuni düzenleme ile birlikte kamu görevlisi kavramı genişletilmiş, kamu hizmeti gören kişilerde görevi kötüye kullanma suçunun faili olabilecek duruma gelmiştir. Suçun maddi unsuru ise görevin gereklerine aykırı hareket etmek suretiyle kişilerin mağduriyetine, kamu zararına veya kişilere haksız kazanç sağlama olarak belirtilmiştir. Bu şartları husule getirmeyen bir fiil görevi kötüye kullanma suçunu oluşturmaz. Bu şartlar ile birlikte görevi kötüye kullanma suçu, zarar suçu haline getirilmiştir. Suçun manevi unsuru ise genel kasttır ve teşebbüse elverişli bir suç tipidir. Görevi kötüye kullanmayı unsur olarak ihtiva eden özel nitelikte bir hüküm mevcut ise söz konusu hükümde yer alan ceza daha hafif olsa bile görevi kötüye kullanma suçundan dolayı faile ceza verilmez. Görevi kötüye kullanma suçu mahsus (özgü) bir suç olup, kamu görevlisi dışındaki kişilerin de iştirak etmeleri mümkündür. Nihai olarak bu suç, görev suçu niteliğinde bulunduğu için 4483 sayılı Memurlar ve Diğer Kamu Görevlilerinin Yargılanması Hakkında Kanun hükümlerinin uygulanması mecburiyeti vardır. Mevcut çalışmada kamu görevlisi kavramı, icrai hareket ile görevi kötüye kullanma suçunun eski ve yeni kanundaki durumunu, eski düzenlemedeki eksiklikleri ve telafi edilip edilmediği hususunu ayrıca yeni düzenlemedeki eleştirilen hususları irdelenmeye ve çözüm bulunulmaya çalışılacaktır. Crime of jurisdiction abuse was regulated in the 257th term of New Turkish Criminal code 5237 in Official Journal published on 12 October 2004 and enacted on 01 June 2005. Crime for jurisdiction abuse has a general and complementary character. The crime regulated under four terms (No 212, 228, 230 and 240) in the Old Turkish Crime code was combined under only one term by avoiding confusions. In addition, contradictions over whether deliberateness is required in Old Turkish Crime code (terms 230 and 240) as well as those about the terms 228 and 240 which were thought to be on the same subjects were removed. In the present study, abuse of executive jurisdiction in 257th term and the first article of (f) new Turkish criminal code is evaluated. The second and the third articles of the term 257, which are about the abuse of executive jurisdiction by omitting or delaying is out of this study because there area already a considerably large number of such studies in literature. This study is confined to the first article of the term in order to make a more specific study. In addition, the aspect of manner, which has not yet been taken into consideration in a complementary way, is evaluated in the study. Perpetrator is public servant executing public work. With the new regulation, the concept of public servant has been widened and people who serving public may turn out to be a perpetrator for public jurisdiction abuse. Physical element of the fault is to harm people by acting contradictory to the requirements of work, causing harms to public goods and providing underserved advantages to certain people. An act which does not cause these results is not the abuse of the jurisdiction because these results can make the fault of jurisdiction abuse a harm. Moral element of the fault is general deliberate and it is a type of fault liable to attempt. If there is a specific decision on the element of jurisdiction abuse, the suspected can not be accused of jurisdiction abuse even if the punish is slighter in the given decision. Jurisdiction abuse is a unique fault and people who are not government officers can be accused of this fault. Since it is the fault on duty, there is an obligation to enact the code 4483 about the justification of government officers and other public attendants. In the present study, situations of the concept of public servant and abuse of executive jurisdiction in the old and new criminal code; defects in the old code and their corrections in the new one; and contradictory points in the new regulation attempted to be evaluated and find solutions.
