11 Eylülde ABD'de, sonrasında da bazı Avrupa ülkelerinde meydana gelen terör saldırıları, adı geçen devletlerde bu tip eylemlerin tekrarlanmaması için sert tedbirlerin alınmasına yol açmıştır. Bu amaçla ABD ve Avrupa devletleri 11 Eylül sonrasında terör faaliyetlerini ve organize suçluluğu önleyebilmek için var olan düzenlemelerini gelişen teknolojilere ve enformasyon alanındaki yeniliklere uygun olarak yeniden reforme ettiler. Daha önceden var olmayan yeni düzenlemeleri de yürürlüğe koydular. Yapılan düzenlemelerin içeriği, güvenliğin ve özgürlüğün algılanmasında farklılıklar ortaya çıkaran ve özgürlükleri ihlal edici bir mahiyet kazandığını gösteren bir sürece dönüşmüştür. Özgürlükleri ihlal etme riski taşıyan ya da ihlal eden bu tedbirler adı geçen ülkelerde özgürlük ve güvenlik dengesinin yeniden tanımlanmasına ve bu dengenin güvenlik lehine değişmesine sebep olmuştur. Öte yandan 11 Eylül sonrasında, diğer önleyici tedbirler kadar, terörle ve organize suçlulukla mücadelede etkili bir yöntem olan önleyici amaçlı iletişimin denetlenmesi tedbiri de söz konusu devletler tarafından fazlasıyla ilgi odağı haline gelmiştir. Dolayısıyla çalışmamızda ABD.de, İngiltere.de ve Almanya.da özgürlükleri ihlal etme riski taşıyan diğer tedbirlerin yanı sıra önleyici amaçlı iletişimin denetlenmesi tedbiri, AİHM kararları ışığında temel hak ve özgürlükler bağlamında incelenmiştir. Ayrıca Türkiye.deki uygulama da bu perspektiften değerlendirilmiştir. Sonuç olarak, önleyici amaçlı iletişimin denetlenmesi tedbiri, özgürlük ve güvenlik dengesi düzleminde ele alındığında, yapılan düzenlemelerde güvenlik kaygısının öne çıktığı ve özgürlüklerin güvenlik amaçlarına göre konumlandırıldığı ortaya çıkmıştır. Aşırı güvenlik kaygısıyla yürürlüğe konulan önleyici amaçlı iletişimin denetlenmesi tedbiri ve özellikle diğer önleyici tedbirler, özgürlük ve güvenlik dengesi açısından güvenlik lehine, özgürlükler aleyhine yeni bir durum ortaya çıkarmıştır. Terrorist attacks occuring in the United States in September 11, after some European countries have led to harsh measures to be taken in order to prevent the repeat of such actions mentioned in this type of states again. For this purpose, the United States and some European States have reformed the existing regulations in line with emerging technologies and suitable to information innovations to prevent organized crimes and terrorist attacks after the September 11 they put into effect new regulations that do not exist previously. The content of the regulations and arrangements has become an essential process which reveals differences in the perception of security, freedom and liberty and that they have gained a characteristic of violating freedom. The measures which carry a risk of violating or disregarding freedoms have led to changes in the redefinition of the balance of liberty and security and change of the balance in favor of security in the mentioned countries. On the other hand, after September 11, as well as other preventive measures and the measure of preventive purposed interception of communication which is an effective method in the fight against terrorism and organized guiltiness has become the focus of extremely attention by mentioned states. Therefore, in the our study, as well as other measures carrying the risk of violating the freedoms in the United States, Britain and Germany, the measure of preventive purposed interception of communication was examined in the context of the decisions of the ECHR were examined in terms of fundamental rights and freedoms. As a result, the measure of preventive purposed interception of communication when taken in the plane of the balance of freedom and security, it has emerged out that security concerns of the regulations have come into prominence and freedoms are positioned according to security objectives. The the measure of preventive purposed interception of communication and other preventive measures which come into effect with an extreme security concerns revealed a new situation in favor of the security and against the liberties in terms balance of freedom and security.
