5271 Sayılı Ceza Muhakemesi Kanunu (CMK), 171.maddesiyle Türk Ceza Muhakemesi Hukukunda kamu davasının açılması bakımından Cumhuriyet savcısına istisnai nitelikte önemli bazı takdir yetkileri tanınmıştır.Ceza Muhakemesi Kanunu md. 171/1’de şahsi cezasızlık sebebi veya etkin pişmanlık hükümlerinin uygulanmasını gerektiren durumların varlığı halinde Cumhuriyet savcısına kamu davasının açma bakımından takdir yetkisi verilmiştir. Aynı maddenin ikinci fıkrasında ise kamu davasının açılmasının ertelenmesi kurumuna yer verilmiştir.Türk Hukukunda 2005 yılına kadar kamu davasının açılmasının ertelenmesi kurumu bulunmamaktadır. Kamu davasının açılmasının ertelenmesi kurumu, hukukumuza 5395 sayılı Çocuk Koruma Kanunu ile girmiştir. Daha sonra 5560 sayılı kanun ile CMK'da yapılan değişiklikle, kamu davasının açılmasının ertelenmesi kurumu, küçükler yanında yetişkinler için de uygulanmaya başlanmıştır. Bu çalışmamızda, Cumhuriyet savcısının şahsi cezasızlık ve etkin pişmanlık hallerinde kamu davasını açmadaki takdir yetkisi ile kamu davasının açılmasının ertelenmesi kurumu, benzer diğer kurumlarla karşılaştırmalı olarak, hukuki niteliği incelenerek, uygulamadaki öngörülen sorunlar ve bunlara çözüm önerileri incelenmiştir. The Public Prosecutor has been granted an exceptionally significant power of discretion regarding filing a criminal case in Turkish Penal Code through article no 171 of Law of Criminal Procedure no 5271. The Public Prosecutor has been granted the power of discretion regarding filing a criminal case in case of the presence of the personal impunity or the cases that require the provisions of the effective repentance to be applied in accordance with the paragraph no 171/1 of Law of Criminal Procedure. The second paragraph of the same article involves the office of the postponement of the public prosecution filing. The Turkish Law has been exercising the office of the postponement of the public prosecution filing since 2005. The postponement of the public prosecution filing has been integrated into our law through Child Protection Law no 5395. The amendment in the Law of Criminal Procedure no 5271 in accordance with the Law no 5560 has involved the postponement of the public prosecution filing for the other people as well as children. In this study, the office of the postponement of the public prosecution filing shall be compared and contrasted with the similar other offices while its legal composition are being investigated and the power of discretion of The Public regarding filing a criminal case in case of the personal impunity and effective repentance as well as the challenges in the practice of the law and the solution offers to these challenges have been studied.
