“Alman ve Türk Ceza Hukukunda Trafik Güvenliğini Kasten Tehlikeye Sokma Suçları” konulu bu yüksek lisans tez çalışması, Süleyman Demirel Üniversitesi Sosyal Bilimler Enstitüsü Kamu Hukuku Anabilim Dalı’nda Profesör Doktor Faruk Turhan danışmanlığında hazırlanmıştır.5237 sayılı Türk Ceza Kanunu’nda Alman Ceza Kanunu’ndaki hükümlere paralel şekilde düzenlenen 179. madde, “trafik güvenliğinin tehlikeye sokulması” başlığı altında olup üç fıkradan müteşekkildir. Esasen her bir fıkra birbirlerinden farklı maddi unsurlara sahip bağımsız suç tipleri olmalarına rağmen tek bir kanun hükmü çatısı altında toplanmıştır. Bunun aksine Alman Ceza Kanunu’nda (md. 315, 315a, 315b, 315c, 316) ilgili hükümler ayrı kanun maddeleri şeklinde düzenlenmiştir. Her iki ülke mevzuatında da suç, tehlike suçu şeklindedir. TCK md. 179’daki suçun unsuru olan kavramların tesbiti noktasındaysa, ilgili trafik türünü düzenleyen özel kanunlara veya yönetmeliklere başvurulması gerekmektedir. TCK md. 179/1’deki suçun işlenmesi, kanunda sayılan seçimlik hareketlerden birinin yapılmasına bağlı olup, belirtilen hareketlerin dışındakiler bu suçu oluşturmamaktadır. Diğer yandan 2. fıkrada, aracın sevk ve idaresinin kişilerin hayat, sağlık veya malvarlıkları açısından kasten tehlike oluşturacak şekilde kullanılması; son fıkradaysa güvenli sürüş yeteneğinin alkol veya uyuşturucu madde alınması sebebiyle veya başka bir nedenle kaybına rağmen aracın sevk ve idare edilmesi hususları yaptırıma bağlanmıştır. Bundan başka, Karayolları Trafik Kanunu ve Yönetmeliği’nde de alkol veya uyuşturucu madde alınarak araç kullanılması yaptırım altına alınmış olup, bahsedilen bu düzenlemeler kabahat niteliğinde olduğundan hem suçun hem de kabahatin tek bir fiille işlenmesi söz konusu olmaktadır. Böyle bir durumda Kabahatler Kanunu md. 15/3 uyarınca, sadece suçtan dolayı yaptırım uygulanacaktır. Buna karşılık Karayolları Trafik Kanunu md. 48/7’de sürücünün uyuşturucu madde kullandığının tesbiti hâlinde hem kabahat hem de suçtan dolayı yaptırım uygulanacağı ifade edilmektedir.Çalışmada akademik tartışmaların yoğunlaştığı nefesten veya kandan alkol ölçümünün yapılması hususları, Anayasanın vücut dokunulmazlığı ve kendi kendini suçlamaya zorlama yasağını düzenleyen 17. ve 38. maddeleri ve CMK’nın şüpheli veya sanığın beden muayenesi ve vücudundan örnek alınmasını düzenleyen 75. maddesi çerçevesinde değerlendirilmiş ve trafik kolluğunun ölçümlerinin hukuka uygun olduğu, ancak ölçüm sonuçlarının teknik ve tıbbi olarak güvenilmez bulunduğu sonucuna varılmıştır.İncelenen TCK hükümlerinin Alman ceza hukukundan ilham alınarak kanun koyucu tarafından ihdas edildiği göz önüne alındığında, tezin Alman Ceza Kanunu hükümleriyle ilgili olan kısmının, TCK’daki kavramların yorumlanması ve anlamının ortaya konması bakımından hukukumuzda kullanılması mümkün görünmektedir. In this graduate thesis which about “The Crimes of Intentionally Jeopardizing of the Traffic Safety in German and Turkish Criminal Law” is prepared under the supervision of Prof. Dr. Faruk Turhan who works at the Suleyman Demirel University, Social Science Institute, Department of Public Law. Article 179, covered under Turkish Criminal Law numbered 5237, which is regulated in parallel with German Criminal Law, is placed under the heading of “jeopardizing the traffic safety” is composed of three articles. Although essentially each article has its own framework of independent offense/crime type, they are consolidated under the roof of one single law. On the contrary, similar articles are referred as separate laws in German Criminal Law (Article. 315,315a, 315b, 315c,316). The concept of offense/crime is used in the sense of endangerment in both of country’s legislation. The determination of offense/crime as part of 179 under Turkish Law must be done in accordance with the special laws on the type of traffic or the relevant regulations.TCK art. 179/1 in offense, the law is due to be made of one of the movements is considered elective, other than the actions constitute the crime. On the other hand, second section of the vehicle dispatch and administration of people's lives, health or deliberately compromised for the use of assets of the last section safe driving ability, or for any other reason due to the use of alcohol or drug despite the loss of the vehicle is connected to sanction the management and administration issues. Furthermore, the Road Traffic Law and Regulations under the sanction of alcohol or drug use on the vehicle and said that the nature of these arrangements, both misdemeanor offense and that offense is committed in a single verb. In such a case, the sanction will be applied only offense in accordance with the Law on Misdemeanors art. 15/3. However, the sanctions are stated to apply in case of identification of the driver has used drugs and misdemeanor criminal offense in accordance with Road Traffic Law art. 48/7.In this thesis, concentrated on academic controversy about matters of the measurement from blood or breath, the articles 17 and 38 are considered about body immunity of the constitution and regulating the ban on forcing itself to blame in accordance with suspect or physical examination and taking sample from body of the accused of the article 75- CMK. Nevertheless, it has been came to the conclusion that legality accordance with measurement of traffic-enforcement officers, but also it has been found unreliable both technically and medically accordance with result of measurement.Considering examined the provisions of TCK, which inspired by the German criminal law establishing by the legislator –in thesis which part is relevant to the provisions of the German Criminal Law- are impossible in terms of interpretation of the meaning of concepts in TCK.
