Terör örgütleri diğer suç örgütlerinden örgütlenme yapıları, örgütsel gizlilik, haberleşme ve suç işleme yöntemleri bakımından farklılık göstermektedir. Klasik soruşturma yöntemleri terör suçlarının soruşturulmasında yetersiz kalmaktadır. Bu nedenlerle, devletler terör suçlarında, kovuşturma aşaması için yeterli delil elde edebilmek amacıyla ceza muhakemesi hukuku sistemlerinde gizli soruşturma tedbirlerini kabul etmişlerdir.Bu çalışmanın amacı, gizli soruşturma tedbirlerinin terör suçları bakımından özellik arz eden uygulanma koşullarını ortaya koyarak, Türk hukukundaki düzenlemelerin AİHS m. 8 ve 6/3-d) hükümlerini ve AİHM’nin bu konuda belirlediği kriterleri karşılayıp karşılamadığını incelemektir.Çalışmada, gizli soruşturma tedbirleri ile ilgili Türk hukukundaki düzenlemeler AİHS, AİHM kararları, Almanya, ABD ve İngiltere’deki düzenlemelerle birlikte ele alınarak incelenmiştir. Çalışmanın birinci bölümünde terör, terörizm, iletişimin denetlenmesi, gizli soruşturmacı, teknik araçlarla izleme kavramları, CMK ve TMK’da yapılan değişiklikler ve terör suçlarında gizli soruşturma tedbirleri kullanılmasının nedenleri ele alınmıştır. İkinci bölümde terör suçlarının soruşturulmasında gizli soruşturma tedbirlerinin uygulanma koşulları, temel hak ve özgürlüklere müdahale teşkil eden özel icra yöntemleri ve elde edilen hukuka aykırı delillerin değerlendirilmesi konularına değinilmiştir. Üçüncü bölümde ise, gizli soruşturma tedbirleri ile ilgili AİHS hükümleri, AİHM’nin tedbirlerin uygulanmasına yönelik belirlediği kriterler ve bu kriterler ışığında Türk hukukunda gizli soruşturma tedbirlerine ilişkin düzenlemeler inceleme konularımızı oluşturmuştur.Türk hukukunda gizli soruşturma tedbirlerinin uygulanmasına yönelik yapılan düzenlemeler genel olarak AİHM kriterlerini karşılamakla birlikte, sorunlu alanlar da bulunmaktadır. İletişimin denetlenmesi tedbirinin kesintisiz uygulanmasına yönelik düzenleme, özel hayatın çekirdek alanını ihlal edebilecek niteliktedir. Teknik araçlarla izleme tedbirinin konutta uygulanamaması ve gizli soruşturmacının suç işleyememesi terörizmle mücadeleyi olumsuz etkilemektedir. TMK’da düzenlenen terör suçlarının birçoğuna gizli soruşturma tedbirlerinin uygulanabileceği katalog suçlar içerisinde yer verilmemesi, terörizmle mücadelede önemli bir eksiklik olarak göze çarpmaktadır. Gizli soruşturmacının tanık olarak dinlenmesi halinde, kimliğinin gizliliğinin korunması ve güvenliğinin sağlanması bakımından CMK ve TKK’da yapılan düzenlemeler ise AİHM kriterlerine uygundur. Ulaştığımız bu sonuçlar, Türkiye’nin terörizmle mücadelesini hukuk devletinin gerekleri çerçevesinde sürdürme gayreti içerisinde olduğunu göstermektedir. Terrorist organisations differ from other criminal organisations in terms of organizational structure, privacy, communication and methods of crime. Conventional investigation methods are inadequate in investigating of terrorist offenses. For these reasons, states have acknowledged undercover investigation measures in terror crimes in order to obtain sufficient evidence for the phase of prosecution in the system of criminal procedure law.The purpose of this study is to examine whether Turkish legislation meets the ECHR Art. 8 and 6/3-d) provisions and the criteria determined by the European Court of HR in this regard while putting forward undercover investigation measures for terror crimes in terms of peculiar conditions of implementation.In this study, Turkish legislations regarding undercover investigation measures are examined together with ECHR, European Court of HR judgments, Germany, the U.S. and the UK legislations. In the first part, terms of terror, terrorism, interception of communication, undercover investigator, surveillance with technical means, amendments in the Code of Criminal Procedure and Code of Counter Terrorism and causes of the use of undercover investigation measures in terror crimes are examined. In the second part, conditions of implementation of undercover investigation measures in the investigation of terror crimes, private enforcement methods of undercover investigation measures that interfere with fundamental rights and freedoms and evaluation of unlawfully obtained evidence are discussed. In the third part, the provisions of the ECHR on the undercover investigation measures and in the light of these criteria as an opinion of the European Court of HR for the implementation of measures and in the light of these criteria Turkish legislations concerning undercover investigation measures are subjects to our research. In Turkish law, although the legislative practices of undercover investigation measures meet the general criteria for the European Court of HR, there are problematic areas. The regulation of uninterrupted interception of communication may violate the core area of private life. Surveillance measure with technical means excluding private property and restraining undercover investigators from committing a crime negatively affect counter terrorism. Some types of crime regulated in the Code of Counter Terrorism are not in the catalog that allows undercover investigation measure, and this creates a significant deficiency in the counter terrorism. The regulations in Code of Counter Terrorism and Code of Witness Protection which enable witness, secrecy and security of undercover investigator comply with the criteria of European Court of HR. The obtained results indicate that Turkey’s counter terrorism is diligently sustained with respect to necessities of rule of law.
