Liberalizmle birlikte adalet idesinin temeline, birey, bireyin hakları ve özgürlüğünün yerleştiğini görüyoruz. Adaletin amacı bu hakların korunmasını sağlayacak bir mekanizma haline gelmektir. Liberalizmde adalet, hakların korunması olarak karşımıza çıkmaktadır. Nitekim liberalizmin fikir babası Locke, doğal haklar konusunda ilk teorisyendir. Liberal öğretiyi savunan Hayek, hakların kullanılmasında özgürlüğü ön şart olarak kabul eder. Ancak burada adalet gerçekleşir. Bu nedenle adaleti çoğu zaman özgürlükle özdeş olarak düşünür. Burada özgürlük ve adalet kavramlarının birbirleri için “amaç mı yoksa araç mı” oldukları birbirine karışmaktadır. Bu tezde; liberal öğreti tarafından yeniden tanımlanan hak ve bununla bağlantılı olarak adalet ile özgürlük kavramları ele alınmış ve bu kavramlar içermeleri bakımından değerlendirilmiştir. We see that in addition to the Liberalism, the individual, the individual's rights and freedom settle in the foundation of the idea of Justice. The aim of justice is to become a mechanism to ensure the protection of these rights. Justice in liberalism emerges as the protection of rights. Indeed, the intellectual father of liberalism, Locke is the first theorist in the respect of natural rights. Hayek who defends the Liberal doctrine accepts the freedom as a prerequisite in the exercise of rights. However justice occurs here. Therefore, he often thinks that the justice is identical to the freedom. Here, the concepts of justice and freedom mingle with each other in the manner that whether they are the "purpose or instrument" for each other. In this thesis; the right that is redefined by the liberal doctrine and in connection to this, the concepts of justice and freedom are addressed and evaluated according to their inclusions.
