İnsanların can, mal, ırz, akıl ve nesillerini korumak için konulan had cezalarının uygulandığı suçların neler olduğu, bu suçların sabit olma şartları, sabit olan suça uygulanacak cezada hangi şartların bulunması gerektiği, modern dönemlerde hadlere, özellikle de CELDE ve EL KESME cezalarına yönelik eleştiriler ile bunlara verilen cevaplar belirtilip gelişen ilim, teknik ve tıp ile beraber EL KESME, KISAS ve RECM cezalarının nasıl uygulanması gerektiği, yeni teknik ve yöntemlerin bu cezalarda kullanılmasının şer'an mümkün olup olmadığı bu çalışmamızda ortaya konulmaya çalışılmıştır. Yapılan araştırma neticesinde modern yöntemlerle hadlerde organların kesilmesi hususunda iki görüş ortaya çıkmıştır. Birinci görüşe göre cezaların, caydırma, ibret olma vb. amaçlar için konması sebebiyle modern yöntemleri had cezalarında kullanmak mümkün değildir. Diğer görüşe göre ise maslahat, istihsan ve diğer yöntemlerden hareketle had cezalarında modern yöntemlerin kullanılması mümkündür. Diğer taraftan günümüzde idam cezalarının infazında kullanılan elektrikli sandalye, gaz odası, zehirli iğne gibi modern idam yöntemlerinin kısas olarak uygulanan idam cezasında kılıcın yerine kullanılması, kılıçla yapılan infazda aranan şartları taşımamaları sebebiyle uygun görülmemiş ama kurşuna dizme ve giyotinle kesmede gerekli şartların bulunması dolayısıyla bunların kısasta kullanımı uygun görülmüştür. Ayrıca recm cezasının kısasa benzetilerek bu cezanın taşın dışında modern bir infaz aletiyle uygulanması tartışma konusu yapılmış ve bunun iki ceza arasındaki birtakım farklılıklar sebebiyle mümkün olamayacağı ifade edilmiştir. Öte yandan çalışmamızda had ve kısas cezalarının infazında anestezinin kullanımı da bu konudaki görüşler çerçevesinde belirtilmeye çalışılmıştır. Buna göre recm, celde ve mağdur veya velinin rıza göstermediği kısas cezalarında anestezi kullanmanın mümkün olmayacağı buna karşın el kesme, ölüm cezası ve mağdur veya velinin rıza gösterdiği kısas cezalarında anestezi kullanımının mümkün olabileceği sonucuna ulaşılmıştır. Yine infazda aranan aleniliğin modern iletişim aletleri vasıtasıyla gerçekleşip gerçekleşmediği araştırılmış ve cezaların teşri nedenleri dolayısıyla bunun mümkünlüğü ifade edilmiştir. Ayrıca hadlere alternatif olarak gösterilen hapis cezası ele alınmış ve bu cezanın olumsuz tarafları belirtilerek hadlere alternatif olamayacağı belirtilmiştir. In this study what are these blames which are practiced in Had punishments and put to protect the people's life, mind, property, chastity, what are being stable conditions of these blames, what conditions must be found to the stable blame which will be practiced blame, together with the chancing time and social situations by the historical and modernists people HAD, especially the criticisms are done to these CELDE and hand cutting punishments and the responds to these criticisms are cleared, together with the developing science technical and medicine HAD, especially how should be practiced HAND CUTTİNG, KISAS, and RECM, punishments, whether the share using possibility of these new techniques and methods on these punishments have been studied. And of the studies two different views have been appeared about using or not using the possibility of modern methods on the HAD punishments. According to the firs view punishments are put to deter and lesson. So using modern methods are not possible on HAD punishments. According to the other view, using modern methods is possible on HAD punishments because of the benefit and other reasons. Besides in these days used like electrically chair, gas chamber, poisonous syringe and hanging modern death methods are used about the execution of the death sentences instead of sword on the death sentences as retaliation are not religiously because of not having the execution conditions. But executing by shooting and cutting by guillotine are religiously because of having the execution conditions. On the other hand "RECM" one of the death punishments is not possible because of same differences with retaliation. These two death punishments are look similar but recm executing has been argued every time except stone. In my thesis besides prison sentences have been performed which is shown as alternative to HAD and shown the negative sides of the prison sentences and it is cleared that it can not be alternative to HAD.
