Mülteci veya sığınma meselesi sadece hukuki bir mesele değil, insani bir meseledir. Bundan dolayı öncelikle, Uluslararası İnsan Hakları Hukukunun mülteci haklarını geliştirmesindeki rolü incelenecektır. 1951 Cenevre sözleşmesi evrensel seviyede müteciler için belirli ve geniş bir hukuki statü ihdas etmiştir. Nitekim bu uluslararası belge hem bölgesel seviyede hem de ulusal seviyede mülteci hakları ve hukuki statüsü ile ilgili düzenlemelere 'esin kaynağı' olmuştur. Bu kapsamda ikinci olarak, 1951 Cenevre sözleşmesi çerçevesinde mülteci hakları incelenecektir. Daha sonra Irak Hukuku'ndaki mültecilerin hakları ve statüsü ile ilgili hukuki düzenlemelerin 1951 tarihli Sözleşme'ye uyumlu olup olmadığı ele alınacaktır. Refugee or asylum issue is not only a legal issue, it is also a humanitarian issue. Therefore, role of International Bill of Human Rights in development of refugee rights will be examined first. 1951 Geneva Convention has created a specific and broad legal status for refugees at the universal level. As a matter of fact, this international document has become a 'source of inspiration' for regulations about refugee rights and legal status both at the regional level and at the national level. Secondly, refugee rights will be examined within the framework of 1951 Geneva Convention in this context. Then, it will be examined whether the legal arrangements about rights and status of refugees in Iraqi law are in compliance with the 1951 Convention or not.
