Şantaj suçu; hakkı olan veya yükümlü olduğu bir şeyi yapacağından veya yapmayacağından bahisle, bir kimsenin kanuna aykırı veya yükümlü olmadığı bir şeyi yapmaya veya yapmamaya zorlanmasıyla ya da yarar sağlamak maksadıyla bir kişinin şeref veya saygınlığına zarar verecek nitelikteki hususların açıklanacağı veya isnat edileceği tehdidinde bulunulmasıyla işlenir. Şantaj suçu, Türk Ceza Kanunu'nun 'Hürriyete Karşı Suçlar' bölümünde düzenlenmiştir. Çalışmamızda şantaj suçunun düzenleniş amacı, eski ve yeni ceza kanununda düzenlenmesi açısından ne gibi farkların olduğu, karşılaştırmalı hukukta nasıl düzenlendiği, şantaj suçunun unsurları incelenmiştir. Özellikle fiil unsuru ayrıntılı şekilde açıklanmıştır. Şantaj suçunun özel görünüş biçimleri anlatılmış; içtima sorunları incelenmiştir. Son olarak şantaj suçunun diğer suç tipleri ile karşılaştırması yapılarak diğer suçlardan farkları ortaya konulmaya çalışılmıştır. The crime of blackmail arises; 1) when a person forces someone to do or not to do something that is unwarranted or he is not obliged to, or forces someone to gain unfair advantage by abusing his or her right or entitlement or 2) in order to gain advantage for himself or someone else, threatening a person by way of making public or attributing the matters that harm the person's honour and prestige. The crime of blackmail is regulated under the heading of 'Crimes against Freedom' in the Turkish Penal Code. This thesis focuses on the rationale for punishing blackmail, amendments on articles regulating the crime of blackmail in the previous and current Turkish Penal Code, how the crime of blackmail is regulated in other legal systems and the components of the crime of blackmail. In particular, the thesis examines in depth objective elements of the crime of blackmail, crime of association, attempt and commission of offenses. The thesis concludes with a comparison of blackmail with other offences and an overview of differences from others.
