Kamu sektörünün gelir kaynağının vergiler, özel sektörün gelir kaynağının kâr olması bu iki sektörün gümrüklerde çıkar çatışmasına girmesine sebep olmaktadır. Bu çıkar çatışması neticesinde gümrüklerde birçok sorunla karşılaşılmaktadır. Gümrük ve Ticaret Bakanlığı'nın 2011 yılında 640 sayılı Kararname ile kurulduğu günden günümüze kadar teşkilat ve gümrük uygulamaları konusunda karşılaşılan sorunlara yeterli düzenlemeleri getirememiş olması gümrüklerdeki sorunları derinleştirmiştir. Bu kapsamda çalışmanın amacı gümrüklerde karşılaşılan sorunları ortaya koymak ve çözüm önerileri getirmektir. Çalışmada öncelikle, gümrükler ve gümrük vergileri kavramsal açıdan incelemeye tabi tutulmuş ve gümrük vergilerinin nasıl tahsil edildiği açıklanmaya çalışılmıştır. Sonrasında gümrük uygulamaları incelenmiş ve gümrük uygulamalarının nasıl suistimal edilerek devletin vergi kaybına uğratıldığı ortaya konulmuştur. Çalışmada kullanılan temel yöntemler ise literatür taraması ve Gümrük Ticaret Bakanlığı personeline kısıtlı ölçüde yapılan anket uygulamasıdır. Bu çalışmada ortaya çıkan temel sonuçlar; gümrüklerde tahsil edilen vergilerin kanunlarında düzenlemeler yapılarak 4458 sayılı Gümrük Kanunu ile uyumlaştırılması, Gümrük ve Ticaret Bakanlığı'nın ise teşkilat yapısında yapacağı düzenlemeler ile denetim yapısını güçlendirerek vergi kaçakçılığının önüne geçmesidir. As the incomes of the public sector are obtained from the taxes and those of the private sector are obtained from the profits these two sectors enter into conflict of interest in the customs. As a result of this conflict of interest, there are many problems in customs. The fact that the Ministry of Customs and Trade failed to bring sufficient regulations to the problems encountered in the organization and customs practices until the day when it was established by Decree No. 640 in 2011, deepened the problems in the customs. The aim of working in this context is to reveal the problems encountered in customs and bring solutions to the problems. In the study, firstly, customs and customs taxes were examined conceptually and tried to explain how customs taxes were collected. Later on, customs applications were examined and it was revealed how the customs practices were abused and the state suffered a tax loss. The basic methods used in the study are the survey of the literature and the application of the limited survey concerning the personnel of the Customs Trade Ministry. The main results of this study are: the taxes collected in the customs must be harmonized with the customs law numbered 4458 by making regulations on them and the Ministry of Customs and Trade must prevent the tax evasion by strengthening the audit structure with the arrangements to be made in its organization structure.
