Günümüzde genellikle fıkıh usûlüne iki önemli işlev yüklenmektedir. Bunlardan ilki, şer'î delillerden yeni hükümler elde etme, ikincisi var olan hükümlerin tutarlılığını ortaya koymadır. Fıkıh usûlüne bu iki işlevin yüklenmesi, fıkhın furûu ile usûlü arasında dinamik bir ilişkinin olması gerektiği düşüncesine dayanmaktadır. Bu düşünceye göre fıkhî hükümlerin fıkıh usûlü teorilerine uygun olarak elde edilmesi gerektiği gibi, fıkıh usûlü teorilerinin de mevcut fıkhî hükümlere uygun olarak kurgulanması gerekmektedir. Bu çalışmada kıyâsın en önemli unsuru olan illetin tespitine ilişkin ortaya atılan te'sîr teorisi bakımından fıkıh-usûl ilişkisi inceleme konusu edilmektedir. Te'sîr teorisi ilk defa kurgulanırken esas olarak selefin uygulamaları ve mevcut fıkhî hükümler dikkate alınmış olsa da teorinin gelişimine yön veren kelâmî tartışmalar da bulunmaktadır. Bu hususta fukahâ ve mutekellimîn geleneğine mensup usûlcülerin yaklaşımları arasında herhangi bir farklılık bulunmamaktadır. Hatta usûlcülerin çoğunluğunun, hanefîlerin aksine, mevcut uygulamaları teorik çerçevenin içerisine alıp onların meşruiyetini koruyan bir yaklaşıma sahip oldukları görülmektedir. Zira ed-Debûsî ile birlikte hanefîler, illet tespitini te'sîrle sınırlı tutan teoriyi benimseyerek, hicrî dördüncü ve beşinci yüzyıl fıkıh literatüründe yaygın olarak kullanılan tardî nitelikteki kıyâsları mümkün olduğunca fıkıh literatüründen çıkarmışlardır. Diğer mezhepler teorik olarak illet tespitini te'sîrle sınırlı tutmadıkları halde, ed-Debûsî ile başlayan eğilim onların fıkıh literatüründe de kaçınılmaz olarak bir dönüşüm başlatmıştır. Bir diğer ifadeyle hanefî teori, genel fıkıh düşüncesini değişime zorlamıştır. Te'sîr teorisinin, bu yönüyle, fıkıh düşüncesini inşa eden ve literatürü şekillendiren bir işlev gördüğü anlaşılmaktadır. It is generally accepted that there are two important functions of usul al-fiqh. First is to obtain new provisions from shar'i evidence, second is to demonstrate the consistency of existing provisions. These two functions are based on the opinion that there should be a dynamic relationship between fiqh and usul al-fiqh. According to this opinion, as the fiqh provisions should be obtained in accordance with the usul al-fiqh theories, usul al-fiqh theories must also be constructed in accordance with the existing jurisprudence. In this study, fiqh-usul relation is examined in terms of the ta'sir theory presented to determine the illa/cause which is the most important element of qiyas. When the ta'sir theory was first constructed, mainly the applications of the allegiance and the existing legal provisions were taken into consideration. There are also some theological discussions that lead to the development of theory. In this respect, there is no difference between the approaches of followers of fukahâ and the mutakallimîn traditions. In fact, the majority of the usulis seem to have an approach that takes the existing applications into the theoretical framework and theoretically protects the legitimacy of existing practices, unlike the Hanafis. Because, along with ad-Dabûsî, the Hanafis accepted the theory which limited the determination of illa to ta'sir and consequently they have extracted formal analogies which are widely used in the fourth and fifth centuries of hijri from the fiqh literature as far as possible. Although other sects did not theoretically limit the determination of illa to ta'sir, the tendency started with ad-Dabusi inevitably initiated a transformation in their fiqh literature also. In other words, Hanafi theory has enforced to change the general idea of fiqh. So it is understood that ta'sir theory functions to shape fiqh thought and the literature.
