Uluslararası Ceza Mahkemesini kuran Roma Statüsü, Roma'da 15 Haziran 1998 tarihinde başlayan Tam Yetkili Temsilcilerden Oluşan Birleşmiş Milletler Diplomatik Konferansı'nda, 17 Temmuz 1998 tarihinde kabul edildi ve 1 Temmuz 2002'de yürürlüğe girdi. Uluslararası toplumun tamamını ilgilendiren ve en ağır insanlık suçlarını yargılamak için kurulan UCM, kendisinden önce kurulan mahkemelerin aksine daimi bir mahkemedir ve uluslararası bir anlaşmaya dayalı olarak kurulmuştur. Mahkeme'nin yargı yetkisine giren suçlar, savaş suçu, soykırım suçu, insanlığa karşı suçlar ve saldırı suçları olarak belirlenmiştir. Bu suçlar, özellikleri bakımından başta saldırı suçu, suçların en kötüsü olarak kabul edilmekte, işlendikleri zaman uluslararası barış ve güvenliği tehdit etmektedir. Dolayısıyla, UCM uluslararası suçları yargıladığı ve faillerini cezalandırdığı zaman, uluslararası cezai adaletin yanı sıra, uluslararası güvenliğin korunmasına da katkı sağlamaktadır. Suçları işleyenlerin uluslararası daimi bir mahkemede yargılanması, aynı zamanda caydırıcılık da oluşturmaktadır. Yargı yetkisi bakımından Mahkemenin en önemli özelliklerinden birisi, Güvenlik Konseyi ile olan ilişkisidir. UCM, uluslararası bir sözleşmeyle kurulduğu için, Güvenlik Konseyi'nin tali bir organı değildir. Ancak Roma Statüsü, UCM'nin yargı yetkisi üzerinde, bazı durumlar için Güvenlik Konseyi'ne önemli yetkiler vermektedir. Ayrıca Statü, md. 13 ve md. 16'da Güvenlik Konseyi'nin UCM'nin yargı yetkisi üzerindeki yetkilerini düzenlemiştir. Statü md. 13 Güvenlik Konseyi'ne, Birleşmiş Milletler Sözleşmesi'nin VII. Bölümü'ne dayanarak, uluslararası barış ve güvenliğin sağlanması için, Statü kapsamındaki bir suçu UCM önüne getirebilme yetkisi vermektedir. The Rome Statute, which has established the ICC, was adopted on July 17, 1998 and entered into force on 1 July 2002. The ICC, which has been established to prosecute the most serious crimes against humanity that concerns the whole of international community, on the contrary to, the courts which had been established before is a permanent court and it, has been established based upon an international agreement. The crimes of the jurisdiction of the court are indicated as war crimes, genocidal crimes, crimes against humanity and crime of aggression. These crimes in respect to their features, crime of aggression being in the first place, are considered as the worst of the crimes and they threaten international peace and security when they are committed. Therefore, when the ICC judges international crimes and punishes the offenders, it contributes both to international criminal justice and the protection of international security. The prosecution of criminals in a permanent international court constitutes deterrence at the same time. One of the most important features of the Court in terms of jurisdiction is the relationship of the Security Council with the Court. Because the ICC has been established with an international contract, it is not a subsidiary body of the Security Council. However, in some cases the Rome Statute gives the Security Council important powers over the ICC's jurisdiction.. Furthermore, the Statute has been regulated the powers of the Security Council on the ICC's jurisdiction in Articles 13 and 16. Article 13 gives the Security Council, based on the UN's agreement's VII. Chapter, in order to international peace and security to be provided, the authority to bring an international crime within the scope of the Statute to the UNC. Statute md. 16 gives the Security Council the right to ask the ICC to postpone a case for 12 months for the same purpose, which is seen as a result of a new situation before the ICC. The aim of the work is to reveal the effects of these authorities on the ICC.
