Ulusal kurtuluş hareketleri ve terör örgütleri birbirleriyle karıştırılan iki uluslararası hukuk konusudur. Karıştırılmalarının nedeni, devletlerin çıkarları gereği farklı olaylarda farklı tutum takınmalarıdır. Bu durum uluslararası barışı ve güvenliği zedelemektedir. Kavramlar arasında net bir sınırın bulunmaması ise sorunun çözümünü ve terör örgütlerine karşı net bir duruş sergilenmesini de engellemektedir. Bu çalışmada, uluslararası antlaşmalar, devletlerin tutumları ve doktrin de göz önüne alınarak her iki kavram arasında hukuki bir ayrım yapılmaya çalışılmıştır. Bu bağlamda, çalışmamızda, ulusal kurtuluş hareketlerinin unsurları tespit edilmeye çalışılmış, ulusal kurtuluş hareketlerinin meşruluğunu etkileyen unsurlar ortaya konulmuştur. Self-determinasyon, kuvvet kullanma ve tanıma gibi farklı uluslararası hukuk konularına değinilmiştir. Çalışmamızın ikinci bölümünde, terör çeşitleri ele alınmış ve terörün unsurları farklı tanımlar ışığında ortaya konulmuştur. Etnik terörle mücadele yöntemleri de çalışmamıza dahil edilerek etnik terörle etkin mücadele örnekleri incelenmiştir. Son bölümde ise ulusal kurtuluş hareketi ve terör örgütü ayrımı uluslararası hukuk yönünden ele alınmaktadır. National liberation movements and terrorist organizations are two international law concepts that are always mixed with each other. The reason why they are confused is that the states have different attitudes in different cases. States can legitimize terrorist organizations for their interests. This situation damages international peace and security.The lack of a clear boundary between the concepts prevents the solution of the problem and a clear stance against the terrorist organizations. A legal distinction has been made between the two concepts, taking into account international agreements, state attitudes and doctrine. In this context, in our study, elements of national liberation movements were tried to be identified and the factors affecting the legitimacy of national liberation movements were put forward. Different international law issues such as self-determination, use of force and recognition are addressed. In the second part of our study, the types of terror are discussed and the elements of terror are put forward in the light of different definitions. The methods of combating ethnic terrorism were also included in our study and examples of the effective struggle against ethnic terrorism were examined. In this context, the National Liberation Movement and the terrorist organization distinction is discussed in the terms of international law.
