2017 Anayasa değişikliğinin 9 Temmuz 2018 tarihinde yürürlüğe girmesiyle Cumhurbaşkanlığı hükümet sistemine geçilmiş, yürütme organında, yürütme organının düzenleme yetkisinin niteliğinde ve yürütme organının düzenleyici işlemlerinde önemli değişiklikler meydana gelmiştir. Değişiklikle beraber yürütme erkine tek başına Cumhurbaşkanı sahip olmuş ve Bakanlar Kurulu ilga edilmiştir. Yürütme organının düzenleyici işlemlerinden olan kanun hükmünde kararname ve tüzük kurumu Anayasadan kaldırılmıştır. Anayasa değişikliği ile Cumhurbaşkanına yönetmelik ve yürütme yetkisine ilişkin alanlarda Cumhurbaşkanlığı kararnamesi çıkarma yetkisi verilmiştir. Yeni bir tür olan Cumhurbaşkanlığı kararnamelerinin alanı ve sınırları konusunda çeşitli belirsizlikler söz konusu olup, çalışmada bunlara çözümler sunulması amaçlanmaktadır. Yürütme organının düzenleyici işlemlerinin Cumhurbaşkanlığı hükümet sisteminde etkili düzenlemeler olup olmadığının, Cumhurbaşkanlığı kararnamelerinin hukuk devleti ve çağdaş demokratik sistemler ile bağdaşıp bağdaşmadığının ortaya konulması ve düzenleme yetkisinin diğer ülkelerde devlet başkanlarına hangi alan ve sınırlarda tanındığının tespiti tezin diğer bir amacıdır. Cumhurbaşkanlığı kararnamesi ile Cumhurbaşkanına olağan dönemlerde de asli nitelikte düzenleme yetkisinin tanındığı, Anayasanın dört maddesinde (m. 104/9, 106/11, 108/4, 118/6) Cumhurbaşkanlığı kararnamesi ile düzenlenmesi öngörülen konular ile Cumhurbaşkanına mahfuz bir düzenleme alanının yaratıldığı ve münhasır kanun alanının Anayasada kanunla düzenlenmesi öngörülen konulardan oluştuğu tezde varılan ana sonuçlardır. Some vital changes occurred on the executive branch, the nature of the regulatory authority of the executive branch and the regulatory procedures of the executive branch after the presidential government system was adopted by 2017 constitutional amendment coming into force on 9th July 2018. With the amendment, the President attained the sole authority of having the executive power and the Council of Ministers was repealed. Statutory decrees and bylaws, which are one of the regulatory procedures of the executive branch were abolished from the Constitution. With the amendment of the Constitution, the President is now authorized to issue regulations and Presidential decrees in the fields related to executive power. There are various uncertainties regarding the scope and boundaries of Presidential decrees therefore this thesis aims to provide some solutions to such problems. The thesis will further tackle the issues of whether the regulatory procedures of the executive branch are effective arrangements in the presidential government system; the presidential decrees are compatible with the rule of law and contemporary democratic systems; and also determine the scope and boundaries of the regulatory authority given to the presidents in other countries. As a conclusion, the thesis argues that the President is even given an authority to regulate presidential decrees in the ordinary periods; is also provided an exclusive regulatory sphere regarding the subjects that need to be regulated by presidential decrees as stipulated in Articles 104/9, 106/11, 108/4 and 118/6 of the Constitution; and the area of exclusive law comprised of the subjects that need to be regulated by code in accordance with the Constitution.
