Türk kamu yönetim sisteminde 657 sayılı Devlet Memurları Kanunu ve personel sistemi sıklıkla tartışılan konulardandır. Kamu personel sisteminde işlevsellik bakımından aksaklıklar oluşması nedeniyle farklı hükümetler tarafından, kamu personel çalışma sistemi ve özlük hakları konusunda kamu personel sistemi yeniden düzenleme yapılan bir alan haline gelmiştir. Bu düzenlemeler bazen torba kanunla bazen de KHK'ler ile yapılmıştır. Bu değişikliklerden birisi son zamanlarda 666 sayılı KHK ve 375 sayılı KHK ile kamu çalışanlarının ücretlerinde maaş dengeleme düzenlemeleridir. Bu irili ufaklı yapılan değişimlerin kamu personel sistemini erozyona uğrattığı söylenebilir. Bu nedenle yeni ve köklü bir kamu personel sistemi oluşturulması gereklidir. Bu değişimin 657 sayılı Devlet Memurları Kanunun köklü bir şekilde değişime uğraması ya da günümüz şartlarına cevap verebilen yapıda kurgulanmasıyla mümkündür. Bu çalışmada, kamuda performansa dayalı ücret sistemleri ve eşit işe eşit ücret uygulaması üzerinde durulmuş olup, eşit ücret hakkının hukuki alt yapısı araştırılarak kamu personel sisteminde eşit işe eşit ücretin kamu kurumlarında nasıl uygulandığı ve ne gibi aksaklıklara yol açtığı üzerinde durulmuştur. Çalışmadan elde edilen sonuçlar ile performansa dayalı ücret sistemleri ve eşit işe eşit ücret uygulamasının kamu personel sistemini idare eden mevzuata katkı yapması amaçlanmıştır. The Turkish public personnel system and the Civil Servants Law No. 657 are frequently discussed. Because of the disruptions in the functionality of the public sector, the public personnel working system and personal rights have become an area where the governments that have taken office have been reorganized by taking over from time to time. From time to time, by law, changes in public personnel systems have been changed by the law. With the Decree Law No. 666 and the Decree Law No. 375, salary balancing methods were applied in the wages of public employees. This large and small changes in the public personnel system is eroding. For these reasons, it is necessary to establish a new and deep-rooted public personnel system. A new law can be created to respond to today's conditions by means of a radical change of the Civil Servants Law No. 657 or the related personnel law. In the study, performance based wage systems in public and equal pay for equal work application are emphasized. In addition, the legal infrastructure of the right of equal pay has been investigated. It is discussed how the equal pay for equal work within the public personnel system is applied in public institutions and what are the causes of disruptions. In this study, it is tried to contribute to performance based wage systems and equal pay to equal work application, as well as to the legislation governing the public personnel system.
