İdarenin sağlık hizmeti bakımından sorumluluğu geçmişte var olduğu gibi günümüzde de varlığını devam ettirmektedir. İdare hukukunun bir parçası olan sağlık hukuku günümüzdeki ihtiyaçlar, toplumda ortaya çıkan gereklilikler nedeniyle ayrı bir hukuk dalı olarak ortaya çıkmıştır. İdarenin sağlık hizmeti bakımından sorumluluğu kusurlu sorumluluk ve kusursuz sorumluluk şeklinde karşımıza çıkmaktadır. Sağlık hizmetlerinden kaynaklı zararların ortaya çıkması durumunda zararın tazmininde hangi sorumluluk türlerine başvurulabileceği, söz konusu sorumluluğun dayanağı, şartları önem arz etmektedir. Fakat sağlık hizmetlerinin sunumu sırasında ortaya çıkan zararların tazmininin kim tarafından gerçekleştirileceği ve hangi usule tabi olduğu hususunda ayrıca ve net bir düzenleme bulunmamaktadır. Bu sebeple çalışmanın amacı, daha çok içtihatlarla belirlenen zararın tazmininin şartları ve sınırlarını tek bir çalışmada toplayarak, sağlık hizmetinin sunumu sırasında zarar gören kişinin izleyeceği yolu somut bir şekilde ortaya koyabilmektir. Çalışmamızda idarenin sağlık hukuku bağlamında sorumluluğu üzerinde durulmuş, bu bağlamda sağlık hakkı, sağlık hizmeti ve sağlık hizmetinin sorumluluk türleri, kapsamı, sınırları ve tazmin usulü doktrin ve yargı kararları ışığında incelenmiştir. The liability of the administration in terms of health services still continues its existence as it was in the past. Health legislation which is a part of administrative law emerged as a separate branch of law due to needs and requirements that emerged in the society. The liability of the administration in terms of health service appear as fault liability and strict liability. In the event of the emergence of health service-based damages, the condition and foundation of the liability type which would be addressed in the compensation of the damage are important. However, there isn't any separate and clear regulation regarding who would compensate and which procedure it is subjected to in the emergence of damages during the presentation of health services. Thus, the aim of this study is to put forward the legal procedures that individuals would follow during the presentation of health services by gathering all of the conditions and limits of compensation of the damage which are mostly determined by judicial decisions. In this research, the liability of the administration in terms of health legislation was emphasized and in this context, the right to health, health service and the types, extent, limits, liability of health services and procedure of compensation were examined in the light of judicial decisions.
