Çalışmamızda farklı himen yapı özelliklerinin cinsel ilişki veya vajinal yolla cinsel saldırı/istismar olup olmadığının ortaya konulmasında ne ölçüde kısıtlılık oluşturduğunu ve bu konuda değerlendirme yapılırken genital bölgenin diğer muayene bulguları, genel beden muayenesi ve ruhsal muayene bulgularının, olayın gerçekleşip gerçekleşmediğine ilişkin görüş oluşturmaktaki önemini ortaya koymak amaçlanmıştır. Bu kapsamda toplumumuzdaki kadınların bir örneklemi olduğu öngörülen adli olgulardan; 1 Ocak 2016-31 Aralık 2018 tarihleri arasında Süleyman Demirel Üniversitesi Tıp Fakültesi Adli Tıp Anabilim Dalında genital muayenesi yapılan cinsel istismar ve cinsel saldırı olguları retrospektif olarak incelenerek benzer çalışmalarla karşılaştırılmıştır. İlk muayenelerde fiziksel bulgu saptanmamasına karşın ruhsal bulgu saptanma oranı daha yüksektir. Çalışmamıza alınan olgularda ilk muayenelerinde genital bölgede fiziksel bulgu saptanma oranı %8,3, genital dışı kalan bölgelerde fiziksel bulgu saptanma oranı %28,9 olarak belirlenmiş, %47,1 olguda ilk muayenelerinde ruhsal bir bulguya rastlanıldığı görülmüştür. Burada adli psikiyatrik değerlendirmenin önemi ortaya çıkmaktadır. Yapılan analizler, fiziksel şiddet/tehdit/zorlamaya maruz kalınmasının, penetrasyon iddiasının bulunmasının ve genital muayenede akut penetrasyona ait bulgular saptanmasının ruhsal bulgu gelişimini önemli derecede etkilediğini ortaya koymuştur. Sosyal ve hukuksal nedenlerle tek başına himen bulgularına odaklanarak muayene uygulamaları bulunmakla birlikte bu muayeneler kültürel nedenler yüzünden onur kırıcı ve hasta haklarına aykırı şekilde değil, suç iddiası olgularında kanıt elde etmek için "genital muayene" adıyla yapılmalıdır. In our study, it was aimed to reveal the limitations of different structural features of hymen in determining whether there is a sexual intercourse or vaginal sexual assault/abuse and the importance of the other physical examination findings of the genital region, general physical examination and psychological examination findings on creating idea about whether the incident has happened or not, while evaluating this issue. In this context, forensic cases which are thought to be a sample of women in our society; the cases of sexual abuse and sexual assault which were genitally examined in the Forensic Medicine Department of Süleyman Demirel University Faculty of Medicine on between January 1, 2016 and December 31, 2018 were analyzed retrospectively and compared with similar studies. Although physical findings were not detected in the first examinations, the rate of psychological findings was higher. In the cases included in our study, the rate of physical findings on the genital region was 8.3% and the rate of physical findings on the non-genital regions was 28.9% at the first examinations. It was observed that there was a mental finding in 47.1% of the cases at the first examinations. The importance of forensic psychiatric evaluation is emerging at this point. Analyzes revealed that exposure to physical violence/threat/coercion, the claim of penetration, and the findings of acute penetration in the genital examination have a significant effect on the development of mental symptoms. Although there are examination practices only focusing on hymen findings for social and legal reasons, these examinations should be performed under the name of "genital examination" to obtain evidence in cases of crime, not in a degrading way or a way contrary to patient rights due to cultural reasons.
