Kefevi'nin Ketaibü a'lâmi'l-ahyâr min fukahâi mezhebi'n-Nu'mâni'l-muhtâr adlı çalışması Osmanlı dönemi tabakât literatürünün en özgün ve kapsamlı Hanefî biyografi eserlerinden biri olup aynı zamanda biyografileri verilen alimlerin ilmî silsilelerini ihtiva etmesi sebebiyle fıkıh tarihi olarak okunmaya ciddi katkıları olabilecek bir eserdir. Bu eserin modern bir neşrinin bu tez çalışması başladığında henüz yapılmamış olması ve hala iyi bir neşrinin de bulunmaması sebebiyle eserin tahkikini hedefleyen bir proje kapsamında bu tez çalışması yapılmıştır. Eserin bir nevi mukaddimesi olarak görülebilecek ve Hanefi tabakâtının başladığı zamandan önceki dönemi konu edinen kısmı, yani Hz. Adem'den başlayıp Hz. Muhammed'e kadar peygamberler ve şeriatları, sahâbe, tabiîn ve müçtehit imamlar döneminde fıkıh ilminin teşekkülüne katkı veren isimlerin ele alındığı kısımlar bu tezin tahkik için esas alındığı bölümdür. Tez çalışması üç bölümden oluşmaktadır. Birinci bölümde müellif ve kitabı tanıtılmakta, ikinci bölümde tahkik kapsamında yer alan metnin içeriği tanıtılmakta ve değerlendirmektedir. Üçüncü bölümde ise eserin ilgili bölümünün elde mevcut nüshalardan seçilmiş dört nüshadan tahkiki yapılmıştır. Burada dört nüshanın verdiği imkanlar doğrultusunda müellif nüshasına en yakın en doğru metni neşretmek hedeflenmiştir. Bu doğrultuda önce birinci bölümde müellif ve eseri özellikle özgün bir içeriğe sahip mukaddimesi esas alınarak tanıtılmaktadır. Ardından gelen iki başlıkta fıkıh ilminin teşekkül sürecinde en önemli halkalardan ikisini oluşturan sahâbe ve tabiîn dönemi fıkhı ve fakihleriyle ilgili değerlendirmeler yer almaktadır. Fıkıh ilminin adım adım nasıl olgunlaştığı ve bu oluşumda aktif rol alan isimlerin kimler olduğu soruları bu bölümlerin mihverini teşkil etmektedir. Nihayet son bölümde ise kendilerine bazen şehir fakihleri (fukaha-i emsâr) ya da müçtehit imamlar adı verilen fıkıh ilminin kurucusu kabul edilen fakihler ve bunların ekolleri ve ilim silsileleri incelenmiştir. Mahmut b. Sulayman al-Kafawi's magnum opus, titled Kataib a'lam al-akhyar min fuqaha'i madh-hab an-Nu'man al-mukhtar is one of the most successful and original biographies of the Hanafi school of law written in the classical age of Ottomans, which is also an attempt to write the history of fiqh through a school of law framework. There was no modern edition of this work when this dissertation has started and still there is no good edition of it. This dissertation is a part of the project that aims to prepare a modern edition of it based on its extant manuscripts which are over 20 worldwide, focusing only the initial parts of the work. Out of the many manuscripts the project selected the four copies to reconstruct the original text written by the author. The first chapter of the dissertation introduces the author and his milieu and works as well as this great work with particular emphasis on the unusual introduction written by al-Kafawi. The second chapter deals with four sections including the prophets, the companions, the successors and the independent jurists. Al-Kafawi, in the section on the prophets, the revealed laws and the last revelation places his history of Hanafi school of law within the broader frames of fiqh and global history. The idea of revealed law and its history constitutes the background of his writings on the Hanafi school of law. The section on the companions focuses on the history of fiqh following the death of the last prophet; the age of Companions of Muhammad shows that some of his Companions developed specialization on the reading of Muhammad's teachings to be later called 'ilm al-fiqh that is the science of revealed law. The initial beginnings were later bolstered by further specialization of the scholars of the successors. Finally the last section of this chapter introduces the true founders of the discipline of fiqh, from whose systematic efforts the schools of law were born. They are called al-a'immah al-mujtahidun, that is, the leaders/masters of legal interpretation, who were also at times called the jurists of the cities (fuqaha' al-amsar). In this section aims the scholarly traditions of each of these masters back to the Prophet Muhammad were given. The final chapter of this dissertation prepares a partial critical edition of the al-Kata'ib, based on the four copies selected out of over twenty existing copies. The method of critical edition is chooing the best and allegedly most representative readings available in one of these four copies.
