Bir toplumda barış ve istikrarın sağlanmasında demokrasiye ihtiyaç duyulmaktadır. Ancak demokratik bir toplumun tesisi ise ifade özgürlüğü bağlamında basın özgürlüğüyle mümkündür. Özgür basın, halkı bilgilendirme, kamuoyu oluşturma ve hükümeti yurttaşlar adına denetleme gibi önemli işlevlerinden dolayı demokrasinin "olmazsa olmaz" şartlarındandır. Basının özgür olmadığı toplumda demokrasiden söz etmek mümkün olmayacaktır. Basın özgürlüğünü Afganistan bağlamında ele alan bu çalışma Afganistan'daki basının özgürlük durumunu inceleyerek ülkede toplumsal barış ve istikrarın sağlanması açısından gerekli olan demokrasinin inşasındaki rolünü ortaya koymayı amaçlamaktadır. Bu sebeple çalışma, daha çok demokrasi ve basın özgürlüğü kavramları ve bunlar arasındaki ilişkilere odaklanmaktadır. Afganistan'da basının özgür olduğu ve demokrasinin inşasında önemli rol oynadığı varsayımına dayanan bu çalışmada her şeyden önce demokrasi ve basın özgürlüğünün kavramsal çerçevesi ele alınmış, ardından Afganistan'da basın özgürlüğünün tarihsel ve hukuki gelişimi incelenmiştir. Son olarak, 11 Eylül saldırıları ardından kurulan yeni yönetim döneminde basın özgürlüğünün gerek hukuki çerçevede gerekse uygulamada yaşanan gelişmeleri ve mevcut olan eksiklikleri kapsamlı şekilde incelenmiştir. In a society, democracy is needed for ensuring peace and stability. However, the establishment of a democratic society is possible with the freedom of the press in the context of freedom of expression. Because of its important conditions such as free press, informing the public, forming public opinion and controlling the government on behalf of citizens, it will not be possible to talk about democracy in a society where the press is not free. This study, which deals with the freedom of the press in the context of Afghanistan, aims to reveal the role of the press in the construction of democracy in the country by examining the freedom situation of the press in Afghanistan. For this reason, the study focuses more on the concepts of democracy and freedom of the press and the relations between them. In this study, which is based on the assumption that the press is free and plays an important role in the construction of democracy in Afghanistan, first of all, the conceptual framework of democracy and press freedom has been discussed, and then the historical and legal development of press freedom in Afghanistan has been examined. Finally, during the new administration period established after the September 11 attacks, the developments and existing deficiencies of the freedom of the press both in the legal framework and in practice were examined in detail.
