Endüstriyel teknoloji ve gelişen üretim süreçlerinin doğrudan etkilediği alanların başında, işçilerin yaşam haklarının güvence altına alınmasını sağlayan ve işyerinde sağlıklı ve güvenlikli bir çalışma ortamının oluşmasına hizmet eden iş sağlığı ve güvenliği alanı gelmektedir. Çünkü modern teknoloji sonucu farklılaşan üretim süreçleri beraberinde değişik üretim teknikleri, artan iş hacmi ve seri üretim biçimi gibi sonuçları getirmiştir. Makineye dayalı üretimin iş sağlığı ve güvenliği alanına verdiği en büyük zarar ise iş kazalarıdır. Dolayısıyla işverenler bu üretim sisteminin işyerine özellikle işçilere vereceği zararları en aza indirmek için gerekli iş sağlığı ve güvenliği tedbirlerini almalıdır. Ancak iş sağlığı ve güvenliği alanı artık uzmanlık gerektiren bir alana dönüşmüştür. Sıradan bir işverenin, işyerinde alınması gereken önlemleri tespit etmesi zor hale gelmiştir. Bu nedenle 6331 sayılı İş Sağlığı ve Güvenliği Kanunu ile işverenlere, dışarıdan ortak sağlık ve güvenlik birimleri olarak faaliyet gösteren şirketler aracılığıyla iş sağlığı ve güvenliği hizmetleri temin etme imkanı getirilmiştir. Bu çalışmada da ortak sağlık ve güvenlik birimi şirketlerinin iş sağlığı ve güvenliği alanında ortaya çıkardığı etkileri ve yaşanan iş kazalarından doğan hukuki sorumluluğu incelenecektir. One of the areas directly affected by industrial technology and developing production processes is the field of occupational health and safety, which ensures the right to life of workers and serves to create a healthy and safe working environment in the workplace. Because the production processes that have changed as a result of modern technology have brought with them different production techniques, increased business volume and mass production style. The biggest damage caused by machine-based production to the field of occupational health and safety is occupational accidents. Therefore, employers should take the necessary occupational health and safety measures in order to minimize the damages that this production system will cause to the workplace, especially to the workers. However, the field of occupational health and safety has now turned into an area that requires expertise. It has become difficult for an ordinary employer to determine the precautions to be taken in the workplace. For this reason, with the Occupational Health and Safety Law No. 6331, employers have been provided with the opportunity to provide occupational health and safety services through companies operating as joint health and safety units from outside. In this study, the effects of the joint health and safety unit companies in the field of occupational health and safety and the legal liability arising from the occupational accidents will be examined.
