Deniz taşımacılığı sektörü 21. y.y.'da gelişen uluslararası ticaret standartları gereğince daha güvenli ve daha çevreci bir taşımacılığı hedeflemektedir. Geçmişi oldukça eskiye dayanan bu sektör, günümüzde en yüksek standartları sağlayarak her anlamda güvenli bir taşımayı ilgililere vaat etmekte ve riskleri en aza indirgemeye çalışmaktadır. Dünya ticaretinde deniz taşımacılığının yadsınamaz önemi, bu sektörün her daim düzenli bir şekilde işlemesini gerektirmektedir. Uluslararası ticaretin düzenli olarak işlemeye devam etmesi büyük oranda deniz taşımacılığı sektörü ile gerçekleşmekte ise de madalyonun diğer yüzünü denizde yaşanan can ve mal kayıpları, deniz kirliliği, gemi adamlarının yaşam koşulları ve güvensiz taşımacılık oluşturmaktadır. Modern toplum düzeninde ticaret ile birlikte kendisini güncelleyen hukuk sistemi bu sorunlar karşısında geminin sefere elverişliliği kavramını karşımıza çıkarmıştır. Mevcut hukuk sistemi gereğince, geminin başlangıçta sefere elverişli halde bulunmasının bir yükümlülük niteliğinde olması, gemide belirli standartları zorunlu kılınmasını gerektirmekte ve güvenli taşımacılığın mihenk noktasını oluşturmaktadır. Geminin sefere elverişliliği kavramı, geminin fiziki ve yapısal kısımlarını, yüke ilişkin gereklilikleri, mürettebatı dahi mahiyetine alarak geminin yüküyle birlikte güvenli bir şekilde varma limanına ulaşması ile ilgili esasları kapsamaktadır. Ayrıca taşıyanın başlangıçta gemiyi sefere elverişli halde bulundurma borcu navlun sözleşmesinden doğan bir yükümlülüğüdür. Çalışmamızda, taşıyanın başlangıçta gemiyi sefere elverişli halde bulundurma yükümlülüğünün ulusal ve uluslararası düzenlemelerdeki yeri ile yeni tip gemiler karşısındaki durumu açılanmaya çalışılacaktır. Sea transportation industry aims at more secure and environmentally appropriate transportation in line with international trade standards that have been developed in 21st century. This industry with a long history promises today a secure transportation in every means to interested parties by providing highest standards and tries to minimize the risks. Undeniable importance of sea transportation in the world trade, demands this industry run in order all the time. Even though international trade needs sea transportation to run smoothly for its survival; there exist a loss of life and goods, a contaminated marine life, an adverse living conditions of shipmen and an unsecure transportation conditions on the other side of the medallion. Legal system that has been updating itself with trade in modern society, has come up with the concept of "seaworthiness of vessel". Seaworthiness classifies whether a ship has passed the required tests and safety checks to be able to sail without any mishaps in accordance with current law. By determining whether or not the ship has been properly assessed, outfitted and maintained, the concept of seaworthiness assures the safety of water transportation. The concept of seaworthiness consists of rules and regulations regarding to the ship and all of its physical parts being reasonably fit for their intended voyage, to the vessel being operated by a crew reasonably adequate and competent for the work assigned, and to its safe arrivel to its destination. The seaworthiness of the ship is the obligation of carrier by the freight contract. In this paper, we will examine the seaworthiness obligation of the carrier under the national and international regulations and up to date tecnological developments in this paper.
