Bu çalışma Tekirdağ ili örneğini çerçevesinde Türkiye'de yaşan yabancı uyruklu kişilerin istihdamına değinilecektir. Bu çalışmayla beraber yabancı uyruklu kişilerin haklarına ve Türkiye'de yabancılara verilen çalışma hakkının kapsamına ve gelişimine değinilmiştir. Araştırmanın amacı farklı sektörlerde çalışan yabancı uyrukluların haklarına, onlara tanınan ve sunulan hukuki düzenlenmelere ve istihdam ettikleri sektörde çalışmaktan ne derece memnuniyet duyduklarına dair tutumu ölçmektir. Ayrıca Türkiye'ye gelen yabancıların istihdamı Türk vatandaşlarının istihdamını olumsuz etkilemektedir. Özellikle 2011 yılında Suriye'de çıkan savaş nedeniyle Türkiye'nin çok sayıda Suriye uyruklu yabancılara kapısını açıp ev sahipliği yapması Türkiye ekonomisi ve istihdamında sorunlara yol açmıştır. Hem ekonomik hem kültürel anlamda karmaşa olmasına sebep olan bu göç sorunu günümüzde hala devam etmektedir. Gelen yabancılar izinli veya izinsiz olarak bir şekilde istihdamda yer almaya başlamışlardır. Bu durum hem yerel halk hem de yabancılar arasında iki taraflı bir soruna yol açmaktadır. Çalışmanın sonucunda yabancı uyruklu kişilerin istihdamının Türk vatandaşlarını da bir hayli ilgilendirdiği kanısına varılmıştır. Yabancıların istihdamının hukuka uygun şekilde sağlanması, kayıt dışı istihdamın önüne geçilmesinde önemli bir adım olacaktır. Türkiye'de yabancılara sağlanan çalışma haklarının düzenlenmesi, ilk başlarda kafa karışıklığına yol açmış olsa da her yeni mevzuat ile beraber yabancılara daha iyi şartlar sunulmuştur. Son çıkan 6735 sayılı kanunla beraber tüm mevzuatlar düzenlenmiş ve akıl karışıklığı ortadan kalkmıştır. Anahtar Sözcükler: Yabancı, İstihdam, İşsizlik, Çalışma Kanunu
In this study, the employment of foreign nationals living in Turkey will be discussed within the framework of the Tekirdag province example. With this study, the rights of foreign nationals and the scope and development of the right to work given to foreigners in Turkey are mentioned. The aim of the research is to measure the attitudes of foreign nationals working in different sectors, on the legal arrangements granted and offered to them, and how much they are satisfied with working in the sector they employ. In addition, the employment of foreigners coming to Turkey negatively affects the employment of Turkish citizens. Especially due to the war that broke out in Syria in 2011, Turkey's opening its doors and hosting a large number of Syrian nationals caused problems in Turkey's economy and employment. This immigration problem, which causes confusion in both economic and cultural terms,, which is still continues today. Incoming foreigners started to take part in employment with or without permission. This situation causes a bilateral problem between both Turkish people and foreigners. As a result of the study, it was concluded that the employment of foreign nationals is also of great interest to Turkish citizens. Ensuring the employment of foreigners in accordance with the law will be an important step in preventing unregistered employment. Although the regulation of working rights provided to foreigners in Turkey caused confusion at first, better conditions were offered to foreigners with each new legislation. With the latest law numbered 6735, all legislation has been regulated and confusion has disappeared. Keywords : Foreigner, Employment, Unemployment, Labor act
