Bu araştırmada evlilik nafakası, bu nafakayı hak etme şartları, hükmü, meşru olmasına dair deliller ve İslam hukukuna göre koca nafaka vermediği zaman ortaya çıkan sonuçlar incelenmiştir. Fakihlerin bu konudaki görüşleri, ihtilafları ve görüşlerine dair delillerine yer verilmiştir. Bu çalışma neticesinde kadın kocasıyla birlikte kalsın veya ayrı kalsın, zifaf gerçekleşsin veya kadının rızası olduğu halde zifaf gerçekleşmesin sahih bir nikah akdi sonucu kadının nafakasının koca üzerinde vacip olduğu sonucuna ulaşılmıştır. Bu çalışmada ayrıca kocanın gaip olması durumunda da onun kendi eşine nafaka vermesi gerektiği sonucuna ulaşılmıştır. Nafaka ile ilgili fakihlerin görüşleri, Kitap ve sünnetten delilleri zikredildikten sonra Burkina Faso Aile Hukuku'nun nafakayla ilgili tutumuna yer verilmiştir. Bu konuda İslam Hukuku ve Burkina Faso Aile Hukuku karşılaştırılmıştır. Bilindiği üzere Burkina Faso, Fransa sömürgesi altında olduğundan onun Aile Hukuku'nun çoğu Fransa devletinin Aile Hukuku'nda alınan pozitif bir hukuktur. Yapılan karşılaştırma neticesinde Burkina Faso Aile Hukuku'nun çok az meselede İslam Aile Hukuku'na benzediği görülmüştür. Bu çalışma iki bölümde ele alınmıştır. Birinci bölümde evlilik nafakasının tanımı, hükmü, bu nafakayı hak etme durumları ve şartları ele alınmıştır. İkinci bölümde kadının nafaka hakkı, kocanın bu nafakayı vermemesinin cezası, kendisine nafaka verilmeyen kadının boşama talebinde bulunma hakkı konusu incelenmiştir. In this research, marriage alimony, the conditions of entitlement to this alimony, its ruling, the evidences regarding its legitimacy and the results when the husband does not pay alimony according to Islamic law are examined. The opinions, disagreements and opinions of the jurists on this subject are given in the evidences of the circle. As a result of this study, it has been concluded that the woman's alimony is obligatory on the husband as a result of a valid marriage contract, whether the woman is small or large, whether she stays with her husband or stays apart, whether marriage takes place or if the marriage does not take place despite the consent of the woman. In this study, it was also concluded that if the husband is absent, he should give alimony to his own wife. After mentioning the opinions and discussions of the jurists about alimony and their evidence from the Book and the Sunnah, the attitude of the Burkina Faso Family Law on alimony is given. In this regard, Islamic Law and Burkina Faso Family Law were compared. As it is known, since Burkina Faso is under the French colony, most of its Family Law is a positive law taken from the Family Law of the French state. As a result of the comparison, it has been seen that Burkina Faso Family Law is similar to Islamic Family Law in very few matters. This study is covered in two parts. In the first chapter, the definition of marriage alimony, its provision, the status and conditions of entitlement to this alimony are discussed. In the second part, the right of the woman to alimony, the punishment of the husband not paying this alimony, the right of the woman who is not given alimony to demand divorce are examined.
