Ceza muhakemesi maddi gerçeği ortaya çıkarmayı amaçlar. Deliller de bu amaca hizmet eder. Bir delil türü olan belirti delillerinin bilimsel gelişmelerle birlikte önemi giderek artmaktadır. Bu çalışmada da her geçen gün daha da önem kazanan belirti delilleri ele alınmıştır. Bu kapsamda belirti delillerinin türleri, elde edilmesi ve ispattaki etkisi incelenmiştir. Çalışmada öncelikle belirtilerin nelerden oluştuğuna yer verilmiştir. Belirti delilleri özelliklerine göre sınıflandırılmış ve tek tek incelenmiştir. Olay yerindeki bu belirtilerin elde edilmesindeki yöntemler her delil için ayrıca ele alınmıştır. Muhakemenin bir parçası haline gelene kadar belirti delilleri çeşitli aşamalardan geçer. Belirtiler olay yerinden ya da diğer delil toplama araçları vasıtasıyla elde edildikten sonra bunların değerlendirilmesi aşamasına geçilir. Bu aşamadan sonra belirtiler muhakeme makamlarınca kullanılabilecektir. Belirti delillerinin toplanması ve değerlendirilmesi yolları çalışmanın ikinci bölümünde ele alınmıştır. Çalışmanın son kısmında usulüne uygun olarak elde edilip değerlendirilen belirti delillerinin suçluluğun ispatındaki yeri incelenmiştir. Belirtilerin ispattaki yeri konusu özellikle yargı kararlarından örneklerle incelenmeye çalışılmıştır. Belirtilerin ispatta birçok rolü bulunmaktadır. Bunlardan ilki belirtilerin diğer delilleri destekleyici rolüdür. Belirtilerin ispattaki diğer bir rolü de birden fazla belirtinin ispatta yeterli olup olmadığı noktasındadır. Belirtilerin tek başına ispat gücü ise belirtilerin ispattaki yeri bakımından incelenmesi gereken diğer başlıktır. Tek delille ispat konusu ayrıca çalışmanın en önemli sorunsallarından birini oluşturmaktadır. Çalışmanın son kısmında bu soruna ilişkin çözümler üretilmiştir. Bu yapılırken de doktrindeki görüşler ve yargı kararlarından yararlanılmıştır. Criminal procedure law aims to uncover the truth. Evidence serve also this purpose. Scientific evidence which is one type of evidence is becoming increasingly important with scientific devolopments. In this study, scientific evidence which are more valuable with each passing day is discussed. In this context, the types of scientific evidence, gathering of this evidence and conclusiveness of an argument is examined. Firstly, what scientific evidence comprised of, is examined. Scientific evidence are classified according to the specifications and studied individually. The method of obtaining this evidence in crime scene individually is inspected for each evidence. Science evidence pass through various stages to be a part of procedure law. This evidence are gathered from crime scene or through the method of obtaining evidence and then they are evaluated. After this stage scientific evidence may be used by the crime procedure authorities. Gathering and evaluating of scientific evidence is inspected in second chapter.In the last part of the study situation in the conclusiveness of scientific evidence which is gathered appropriately is discussed. The situation in the conclusiveness of scientific evidence is studied specially with examples of judicial decisions. This matter can be discussed under three headings. The first of these is the role of supporting other evidence of scientific evidence. Another role in the conclusiveness of scientific evidence is relevant to the situation in the conclusiveness of more than one scientific evidence. The conclusiveness of an argument of singly scientific evidence is the other heading. The conclusiveness with one evidence is one of the most important problematical pieces of study. In the last part of the study solutions which about this problem are produced. While doing this, the opinions of the doctrine and judicial decisions are used.
