Türkiye’de büyükşehir belediyesi özel yönetim biçiminde bir mahallî idaredir. Büyükşehir belediyeleri yakın bir tarihi sürece sahiptir. Büyükşehir belediyelerinin yapıları kısa bir süre önce değiştirilmiştir. Bu makalede büyükşehir belediyelerinin yapılarının ve bu yapıdaki değişikliklerin Anayasaya aykırı olduğu dile getirilmekte ve iddia edilmektedir. Bu aykırılık, belediye meclisinin ve encümeninin teşekkül biçimlerinde görülmektedir. Büyükşehir belediyelerinde yeni değişiklik yapan 6360 sayılı kanun da birçok yönden Anayasaya aykırıdır. Anayasaya aykırılık iddialarının gerekçeleri hukukî metodla açıklanmış ve Anayasaya uygun büyükşehir yapısı önerilmiştir |

The metropolitan municipality is a kind of local government in the form of a special administration in Turkey. The metropolitan municipalities have brand new phenomenon in Turkish administrative system. The structure of the metropolitan municipalities was amended recently. In this paper, it is claimed that the certain structures of the metropolitan municipalities and new legal framework are contrary to the Constitution. This contradiction may be related to formation of the municipal council and the town council. Also according to the law No. 6360, which has just amended the structure of the metropolitan municipalities is seen contrary again to the Constitution. The reasons for the claims tried to evaluated of certain contradiction with the Constitution are explained in a legal method and the model structure of metropolitan municipalities in accordance with the constitution is proposed in the article |
