Alman Anayasa Mahkemesi’nin Lüth Kararı’nda bu konuyla ilgili önemli kıstaslar geliştirilmiştir. Önümüzdeki çalışmada, söz konusu kararın içeriği ve doğurduğu neticeler analiz edildikten sonra, temel hakların özel kişilere karşı doğrudan veya dolaylı etkisinin Türk Hukuku’ndaki görünüş şekillerine yer verilecektir |

It is possible to say that there is the influence of fundamental rihgts between citizens and the state beside this direct or indirect influence to third parties. Important maxims are enhanced by the German Constitutional Court in the Lüth decision. First, the content and the emerging results of the decision in question will be analysed afterward the direct or indirect influence of fundemental rights against real person appearing forms in Turkish law will be examined |
