Türk Ceza Kanununun 223. maddesinde “Ulaşım Araçlarının Kaçırılması veya Alıkonulması” suçu düzenlenmiştir. Ulaşım araçlarının kaçırılması ve alıkonulması suçu ile ulaşım güvenliği ve seyahat özgürlüğü korunmak istenmiştir. Kıt’a sahanlığı veya münhasır ekonomik bölgedeki sabit platformların işgali suçu ile ise devletin hakimiyet yetkisi korunmak istenmiştir. Ulaşım araçları açısından kanun koyucu bir sınırlama getirmemiştir. Her iki suç tipi açısından da failin herhangi bir hukuka uygunluk nedeni kapsamında hareket etmemesi gerekmektedir. Çalışmamızda bu iki suç tipi unsurlarıyla birlikte ele alınmış, suçların nitelikleri değerlendirilmeye çalışılmıştır |

“Stealing and confiscation of transportation vehicles” crime is regulated in Article 223 of Turkish Penal Code. “Stealing and confiscation of transportation vehicles” crime’s aim protect to transportation safety and freedom of travel. “Occupation of Territorial land or stationary platform in specific industrial zones” crime’s aim protect to the dominance of the state authority. Means of transport is not limitated by the legislator. The perpetrator’s act should be unlawfully for both of these crimes. In this study these crimes are discussed with elements, the nature of these crimes are assessed |
