İnsan hakları teorisiyle yakından ilişkili olan temel hak ve özgürlüklerin günümüzde pozitif hukuk ile düzenlenmesi konusu genel kabul görmüştür. Özgürlüğün her bakımdan sınırsız olamayacağı genel kabulünden yola çıkarak günümüz demokrasilerinde özgürlüklerin değişik sebeplerle sınırlandırıldığı müşahede edilmektedir. Bu bağlamda 1982 Anayasası, temel hak ve özgürlükler için üçlü bir sınırlama sistemini benimsemiştir. 13. maddede birtakım genel sınırlama nedenleri sayılmış, ayrıca ilgili maddede öngörülen özel sınırlama nedenleri getirilmiş ve sonra da özgürlükler, Anayasanın sözüne ve ruhuna uygun olarak, kanunla sınırlanabileceği belirtilmiştir. 2001 yılında 13. maddede yapılan değişiklik ile temel hak ve özgürlüklerin kısıtlanması konusunda artık genel nedenler uygulamasından vazgeçilmiş, her bir maddede yer alan nedenlere dayanılarak kısıtlama yapılabileceği kuralı benimsenmiştir. 13. maddenin yeni şeklinde, "laik cumhuriyetin gerekleri" sınırlamanın sınırını oluşturan bir ölçüt şeklinde yer almıştır. Yapmış olduğumuz bu çalışma ile, 2001 değişikliğinde 13. maddeye giren temel hak ve özgürlüklerin sınırlandırılmasının bir koşulu olarak laik cumhuriyetin gereklerine uygunluk incelenecektir. Bu bağlamda laiklik ilkesi açıklanacak ve bu ilkenin yasal pratikte yansımaları, din ve vicdan özgürlüğü çerçevesinde ele alınacaktır. It is generally accepted that the fundamental rights and freedoms that are closely related to human rights theory are regulated by positive law. Based on the general acceptance that freedom cannot be unlimited in all respects, it is observed that the freedoms in today's democracies are limited by different reasons. In the 1982 Constitution, it subjected a tripartite system of limitations. In Article 13, a number of general reasons for limitation were counted, and the specific reasons of restriction provided for in the relevant article had been introduced, and then freedoms could be restricted by law, in accordance with the word and spirit of the Constitution. In 2001, the amendment to Article 13 has now relinquished the application of general grounds for the reduction of procedural rights and freedoms, and the rule that restrictions could be made based on the reasons set out in each article. With the amendment made in 2001, in the new form of Article 13, iyet the requirements of the secular republic "has taken the form of a criterion that limits the limitation. With this study, we will examine the conformity to the requirements of the secular republic as a condition of the restriction of fundamental rights and freedoms under Article 13 of the 2001 amendment. In this context, the principle of secularism will be explained and the reflections of this principle in legal practice will be discussed within the framework of freedom of religion and conscience.
