Allah insanları kendini tanıyıp bilmesi ve kendine ibadet etmesi için yaratmıştır. Yaradılış gayesi olarak eda edilen ibadetlerde, bazen hata ve kusur işlemek bazen de ibadetleri yapmaktan aciz durumuna düşmek insan olmanın gereğidir. Bu durumlara karşılık Allah kullarına tevbe kapısı açmış, hata ve kusurlarını telafi edebilmeleri için mali ve bedeni bazı yaptırımlar, acizlikten dolayı ibadetlerini yerine getiremeyen kullarına da bedel mahiyetinde bazı ruhsat ve kolaylıklar tanımıştır. Çalışmamızın da konusu olan bu yaptırımlara İslam Hukukunda keffaret ve fidye denilmektedir. Bu çalışma giriş ve iki bölümden oluşmaktadır. Giriş bölümünde keffaret ve fidye kavramlarının semavi dinlerdeki yeri ve tarihsel süreci, geçmişten günümüze uygulanması ve son olarak bu iki fıkıh teriminin birbiriyle ilişkisi incelenmektedir. Birinci bölümde konu ile ilgili altyapı oluşturulmakta, keffaret ve fidye ile ilgili detaylı bilgi verilmektedir. Her iki kavramın sözlük ve ıstılah anlamları, çeşitleri, keffaret ve fidyeyi gerektiren durumlar, miktarları ve tasarruf yerleri ele alınmaktadır. Hükümleri konusunda Hanefi mezhebi görüşüne öncelik verilmekle birlikte Malikî, Şâfiî ve Hanbelî mezheplerinin görüşlerine de yer verilmektedir. İkinci bölümde ise tezin ana konusu olan keffaret ve fidye kelimelerinin ilişkisi incelenmekte, ikisinin benzediği ve ayrıldığı noktalar tespite çalışılmaktadır. Keffaret ve fidye gerektiren durumlar mukayeseli olarak ele alınmaktadır. Sonuç olarak keffaret ve fidye kelimelerinin birbiri ile olan bağlantıları tespit edilmeye çalışılmakta, her iki kavramı birbirinden ayıran ince nüans İslam fıkıh literatürü ışığında ortaya konulmaktadır. God created people to know Himself and to worship Himself. In worships, which are performed as the purpose of creation, sometimes to commit mistakes and defects and sometimes to be incapable of performing worships are the necessity of being human. In response to these situations, Allah has opened the door of repentance to His servants, and has imposed some financial and physical sanctions to compensate for their mistakes and flaws, and granted some permits and conveniences to the servants who cannot fulfil their worships due to insolvency. These sanctions, which are the subject of our study, are called kaffara and fidya. This study consists of an introduction and two parts. In the introduction part, the place and historical process of kaffara and fidya in monotheistic religions, their application from past to present and finally the relationship between these two fiqh terms are examined. In the first part, infrastructure is established and detailed information is given about them. Lexical and technical meanings of both concepts, types, situations that require them, their amounts and saving places are discussed. While the Hanafi school view is given priority in its judgments, the views of the Maliki, Shafi and Hanbali schools are also included. In the second part, the relationship between the words of kaffara and fidya, which is the main subject of the thesis is examined and the points where the two are similar and separated are tried to be determined. The situations requiring them are handled comparatively. As a result, the relationship between these two words is tried to be determined, and the subtle nuance separating them is presented in the light of Islamic fiqh literature.
