Ahkâm Âyetlerinin Hukuk Analizi İbn Kesîr Örneği; başlıklı tez çalışmamızda, İslam coğrafyasında şöhret bulmuş olan; muhaddis, fakih, müfessir İbn Kesîr'in (ö. m.1301/h.701) kaleme aldığı Tefsîrü'l-Ḳurʾâni'l-ʿaẓîm adlı eserindeki hukuka tealluk eden âyetlerin tefsîrinde, İbn Kesîr'in analizleri ile yaptığı izahatların bir araya getirilmesi amaçlanmıştır. Müfessirin eseri, rivayet tefsîri olup Kur'an-ı Kerim'in tamamı üzerine yazılmıştır. Tez çalışmasının kapsamına ise sadece ahkâm âyetleri dahil edilmiştir. Âyeti kerimelerin tefsîrinde müfessirin aktarmış olduğu hadis rivayetlerinin farklı senetlerle tekrar edilmesinden ötürü konunun anlaşılmasına katkı sağlayacak kadar rivâyet aktarılmış, sahabe ve tabiin kavillerine müracaat edilmiş, ayrıca müfessirin yaşadığı devre kadar yazılan tefsîr eserlerinden naklettiği yorumlarda, kısaltılarak tez çalışmasında yer almıştır. İbn Kesir'in tefsîrinde belli bir usul takip etmediği ve hükümleri nakledip içtihada da pek girmediği gözlemlenmiştir. Âyetin âyet ile ve âyetin hadis ile neshini kabul ettiği görülmüştür. Zikrettiği delillerde âyet ve hadisler için nas tabirini kullandığı ayrıca mezhebi olan Şafiîliğin kullandığı dile etkisi olduğu da görülmüştür. Ehli sünnet mezhepleri arasındaki ihtilaf edilen konular ve mezheplerin kullandıkları delilleri tefsîrine eklemiştir. Çalışamada ihtilafa konu olan mezhep görüşleri kısmen aktarılmış olup ibadet konuları ise dahil edilmemiştir. In our thesis titled, legal Analysis of Ahkâm Verses sample of Ibn Kesir; The muhaddis who found fame in the Islamic geography, It is aimed to bring together Ibn Kesir's analysis and his explanations. In the interpretation of the verses of the law in his work Tefsîrü'l-Ḳurʾâni'l-ʿaẓîm, written by the jurist, interpreter, Ibn Kesir (d. 1301 / h.701). The work of the commentator is a narration interpretation and is written on the whole of the Quran. Only the verses of judgment were included in the scope of the thesis study. Due to the repetition of the hadith narrations by the commentators in the interpretation of the verse, the narrations that will contribute to the understanding of the subject, the companions and the natives were applied to, and the commentaries of the tafsir books written until the time of his life were shortened and included in the thesis. It has been observed that Ibn Kesir did not follow a certain method in his interpretation and did not follow the ijtihah method by quoting the provisions. It is seen that the verse accepts the abrogation of the verse and the verse with hadith. In the evidences he mentions, he uses the word nas for verses and hadiths. It has also been seen that the sect of Shafiism has an effect on the language he uses. He added the disputed issues among the Sunnah sects and the evidences used by the sects to his interpretation. In the study, the disputed sectarian views were partially conveyed, and the subjects of worship were not included.
