Sebepsiz zenginleşme Türk hukukunda hukuki işlemler ve haksız fiil ile birlikte ayrı bir borç kaynağı olarak düzenlenmiştir. Bu sebeple sadece Türk Borçlar Kanunu'nda değil diğer birçok kanunda da sebepsiz zenginleşme hükümlerine atıf yapılmıştır. Mevzuatın yanı sıra öğretide de farklı hukuki problemlerin çözümünde sebepsiz zenginleşme hükümlerinden yararlanma eğilimi gelişmektedir. Özellikte Türk Medeni Kanunu'nun konusunu oluşturan aile hukuku, eşya hukuku ve miras hukuku gibi hukuk dallarında sebepsiz zenginleşme hükümlerine birçok yerde atıf yapılmaktadır. Diğer birçok hükmün yorumlanmasında da öğretide gelişen eğilimin bir sonucu olarak uygulamanın sebepsiz zenginleşme kurallarına başvurduğu görülmektedir. Sebepsiz zenginleşmenin hukukumuzda kapladığı geniş yere rağmen bu konuda yapılan akademik çalışmaların azlığı ise dikkat çekmektedir. Çalışmada sebepsiz zenginleşme genel hatlarıyla ele alınmakla beraber özellikte Türk Medeni Kanunu'ndaki görünümleri incelenmiştir. Sebepsiz zenginleşmenin uygulama alanı ile ilgili öğretideki tartışmalara yer verilerek, Yargıtay'ın bu tartışmalara yönelik görüşlerine de sıkça değinilmiştir. Türk Medeni Kanunu'nda sebepsiz zenginleşme kurallarına atıf yapılan hükümlerle sınırlı kalınmamış, uygulamada sıkça sebepsiz zenginleşmeye dayanan iade taleplerine yol açan hükümlerde çalışmanın içerisinde incelenmiştir. Son olarak kanunun sebepsiz zenginleşmeyle ilgili doğrudan düzenleme yapmadığı ancak öğretide ve uygulamada sebepsiz zenginleşme ile ilişkilendirilen hükümler incelenerek çalışma tamamlanmıştır. Unjust enrichment is regulated as a separate source of obligation in Turkish law alongside contract, tort and agency without authority. Therefore, there are many references to unjust enrichment rules in not only Turkish Code of Obligations but in numerous other codes. Besides the legislation, there is a growing trend in doctrine to use unjust enrichment as a solution to different legal problems. Especially in Family Law, Inheritance Law and Property Law, which are subjects of Turkish Civil Code, there are many articles that references to unjust enrichment rules. Following the trend in the doctrine, some other articles are being interpreted by the judiciary in light of unjust enrichment rules. Despite the great importance of unjust enrichment in Turkish Law, there are only few academic studies on the subject in our literature. Although unjust enrichment was discussed generally in the study, specifically its reflections in Turkish Civil Code were analyzed. Different opinions in doctrine and jurisprudence about the applications of unjust enrichment rules were included in the study. Various articles of the Turkish Civil Code were made part of the study, not just limited to the articles that makes direct references to unjust enrichment rules. Finally, the study is concluded with the examination of the articles of the Turkish Civil Law that does not regulate unjust enrichment rules directly but associated with it in doctrine and jurisprudence.
