Bu çalışmada, Yargıtay kararları ışığında çekte zamanaşımına ilişkin düzenlemeler incelenmiştir. Çekte zamanaşımına ilişkin temel düzenleme 6102 sayılı Türk Ticaret Kanunu madde 814’tür. Hükümde çekte hamilin ve çek borçlularından birinin diğerine karşı sahip olduğu başvurma hakkı, belli bir zamanaşımı süresine bağlanmıştır. Hüküm bağlamında öncelikle hamilin, başvurma borçlularına ve çek bedelini ödeyen başvurma borçlularının birbirlerine karşı açacağı davalar açısından zamanaşımı süreleri ele alınmıştır. Ardından çekte zamanaşımını kesen ve durduran sebeplere değinilmiştir. Son olarak çekin zamanaşımına uğramasının hukuki sonuçlarına yer verilmiştir. |

In this study, the regulations regarding the prescription on the check were examined in the light of the Supreme Court decisions. The basic regulation regarding the prescription on a check is article 814 of the Turkish Commercial Code No. 6102. In the provision, the right of application of the check holder and one of the check debtors against the other is bound to a certain limitation period. In the context of the provision, first of all, the prescription for the cases that the holder, the debtors of the application, and the debtors of the application, who pay the check, will be brought against each other are discussed. Then, the reasons for interrupting and stopping the prescription on the check are mentioned. Finally, the legal consequences of the prescription of the check are given. |
