Toprak üzerinde mülkiyet meselesi tarihte çok farklı şekillerde karşımıza çıkmaktadır. Belirli dönemlerde bu mülkiyet devletlerin ve zenginlerin tekelinde olmuş hatta bunlar toprağın üzerindeki her şeye insan da dahil olmak üzere sahip olmuştur. Ancak günümüzde özel mülkiyeti konu alan arazilerin sayısı artmış, sosyal devlet ilkesinin esas alınması ile devletin kamu yararı için var olduğu düşüncesi yaygın hale gelmeye başlamıştır. Bunun neticesinde devlet, özel mülkiyete yalnız kamu yararı söz konusu olduğunda müdahale edebilmektedir. Osmanlı hukukunun kanunlaştırma asrı olan Tanzimat devrinde de istimlake dair önemli düzenlemeler yapılmıştır. Makalede kronolojik sıra gözetilerek Osmanlı hukukunda istimlak düzenlemeleri ayrı alt başlıklar altında tetkik edilmiştir. Ayrıca tüm bu mevzuatın yazı çevrimi makaleye eklenmiştir. |

The issue of ownership of land appears in many different ways throughout history. In certain periods, this property was under the monopoly of states and the rich, and they even owned everything on the land, including people. However, today, the number of privately owned lands has increased, and with the principle of social state as a basis, the idea that the state exists for the public benefit has begun to become widespread. As a result, the state can only intervene in private property when it is in the public interest. During the Tanzimat period, which was the century of codification of Ottoman law, important regulations were made regarding expropriation. In the article, expropriation regulations in Ottoman law were examined under separate subheadings in chronological order. Additionally, the transcription of all this legislation has been added to the article. |
