İnsanın sınırsız güç elde etme isteği ve iktidar olma mücadelesi insanlıkla yaşıttır. İktidarlar, güç mücadelesine giriştikçe o otoriteyi ve gücü dengeleme amacı güden farklı fikirler ortaya atılmıştır. Bu fikirlerin temel amacı iktidar keyfiliğinin önlemesi olmuştur. Benzer süreçlerin Osmanlı – Türk hukukunda da yaşandığı söylenebilir. Bu doğrultuda, Osmanlı padişahının yetkilerinde yaşanan değişimi görmek amacıyla çalışmada klasik dönemden başlanarak sırasıyla Tanzimat'a hazırlık dönemi, Tanzimat dönemi ve Meşrutiyet dönemleri üzerinden padişah otoritesinin değişim süreci anlatılmıştır. İfade edilen dönemler içerisinde padişah otoritesi ve bu otoritenin sınırları tespit edilmeye çalışılmıştır. Bu tespit yapılırken otoritenin sınırlarının nasıl ve hangi mekanizmalarla belirlendiği ortaya konmuştur. Özellikle belirtilen dönemlerde ilan edilen belgelerin, açılan kurumların ve yaşanan diğer gelişmelerin hukuki mahiyeti ve etkisi hukukçuların görüşleri ışığında ayrıca tartışılmıştır. Genel olarak bu çalışmada, "Osmanlı Devleti'nde iktidar sınırlandırılmış mı? Sınırlandırılmışsa hangi araçlarla, ne şekilde sınırlandırılmış ve nasıl değişime uğramıştır?" sorularına ortaya konan bulgular çerçevesinde cevap verilmeye çalışılmıştır. Son olarak, Türkiye Cumhuriyeti'nde yaşanmış ve yaşanacak olan iktidarın sınırlandırılması tartışmalarının temelinin anlaşılması bağlamında ortaya konan bu çalışmanın önem arz ettiği söylenebilir. Man's desire to gain unlimited power and his struggle for power are as old as humanity. As the governments engage in a power struggle, different ideas have been put forward to balance that authority and power. The main purpose of these ideas was to prevent the arbitrariness of power. It can be said that similar processes were experienced in Ottoman - Turkish law. In this direction, in order to see the change in the authority of the Ottoman sultan, the change process of the sultan's authority is explained, starting from the classical period, through the preparation period for the Tanzimat, the Tanzimat period and the Constitutional Monarchy periods, respectively. The sultan's authority and the limits of this authority were tried to be determined within the stated periods. While making this determination, it has been revealed how and by which mechanisms the limits of authority are determined. In particular, the legal nature and impact of the documents announced in the specified periods, the institutions opened and other developments are also discussed in the light of the opinions of the lawyers. In general, in this study, "Is the power limited in the Ottoman State? If it is limited, by what means, by what means, and how has it changed? It has been tried to answer the questions within the framework of the findings. It can be said that this study, which is put forward in the context of understanding the basis of the debates on the limitation of power that has been and will be experienced in the Republic of Turkey, is important.
