Çek bir kambiyo senedidir. Bu nedenle çekte "şekle sıkı sıkıya bağlılık ilkesi" ve "mücerretlik ilkesi" geçerlidir. Bu bağlamda, çekin zorunlu unsurlarındaki eksiklik çekin geçersizliğine neden olmaktadır. Keza, çekin üzerine yazılan bir kaydın anılan ilkeleri ihlal etmesi, çekin geçersizliği sonucunu doğurur. Buna karşılık, bir yandan da senedin ayakta tutulması ve hamilin korunması istenmektedir. Ayrıca çeke olan güveni artırmak ve karşılıksız çeki önlenmek amacıyla çek mevzuatında birçok değişiklik yapılmaktadır. Değişikliğe konu olan temel konulardan biri, çekin unsurlarıdır. Bu bağlamda, üç bölümden oluşan "Çekin Unsurları" başlıklı bu tez hazırlanmıştır. İlk bölümde; çeke ilişkin genel bilgiler verilmiş, çek ilişkisinin doğuşu ele alınmıştır. İkinci bölümde, çekin unsurları kapsamlı şekilde irdelenmiştir. Üçüncü bölümde, çeke konulabilecek ihtiyari kayıtlar ele alınmıştır. Cheque is a type of bill of exchange. Therefore, "principle of sticking strictly to the form of instrument" and "abstractness principle" are valid in the cheque. In this context, deficiency in the obligatory elements of the cheque causes the cheque to be invalid. Likewise, if a clause written on the cheque violates the aforementioned principles, this will result in the invalidity of the cheque. On the other hand, it is desired to sustenance of the bill and protect the holder. In addition, many changes are being made in the cheque legislation in order to increase confidence in cheque and prevent dud cheque. One of the main issues subject to change is the elements of the cheque. In this context, this thesis titled "Elements of the Cheque", consisting of three parts, has been prepared. In the first part; general information about the cheque is given and the birth of the cheque relationship is discussed. In the second part, the elements of the cheque are examined extensively. In the third part, voluntary clauses that can be written on the cheque are discussed.
