Geçmişte eşcinsel davranış sergileyen kişiden bağımsız olarak hemcinsler arası cinsel ilişkiyi ifade eden eşcinsellik kavramı, günümüze gelindiğinde eşcinsel bireyin duygu, düşünce ve davranışlarını da kapsayan daha geniş bir kavramsal içerik kazanmıştır. Bu bağlamda çalışmamızın amacı eşcinsellikle ilgili kavram kargaşasını açıklığa kavuşturmak, eşcinsellik algısını dönüşüm kodlarıyla birlikte tahlil ederek İslam hukuku açısından eşcinsellik kavramını değerlendirme noktasında daha isabetli sonuçlara varmaktır. Tezde eşcinsellik meselesini sadece eşcinsel ilişkiyle ve eşcinsel ilişkiye yönelik cezâî hükümerle sınırlandırmaksızın eşcinselliği psikolojik, davranışsal ve sosyal yönleriyle de ele alarak konuyu daha geniş bir perspektiften değerlendirmek hedeflenmiştir. Böylelikle meseleye daha kapsamlı ve daha gerçekçi çözümler sunmak mümkün olacaktır. Araştırmamızda öncelikle, günümüzde türetilen kavramsal içeriğiyle eşcinsellik tanımlanarak bu kavramın İslam hukukunda karşılık bulan anlamı ortaya konmuştur. Modern dönemde psikoloji ve sosyoloji alanındaki bazı bilim çevreleri tarafından bir problem olarak ortaya konulan, eşcinselliğin insan doğasına aykırı olup olmadığı meselesine ya da insanın normali midir sorusuna İslam hukuku perspektifinden çözüm aranmıştır. Bu bağlamda eşcinselliğin fıtratla ilişkisi incelenmiş ve İslam hukuku açısından eşcinselliğin, bazı psikolojik ve sosyolojik faktörlerin etkisiyle insanın yaşamında sonradan meydana gelen ve insan fıtratına aykırı olan bir durum olduğu tespitine varılmıştır. Fıtratı değiştirmek yönüyle eşcinselliğin hükmü beyan edilmiştir. Hemcins cinsel birliktelikler, zina suçu gibi aileyi ve nesli olumsuz etkileyen toplumsal bir suç olarak İslam ceza hukuku kapsamında değerlendirilmiştir. Eşcinsel ilişki konusunda fakihlerin ortaya koydukları cezâî hükümler, delilleri ve fakihlerin yorumlarıyla birlikte ele alınarak bu hususta isabetli hükme varılması konusunda katkı sağlanmıştır. Bunun dışında eşcinsellik, eğilim, tavır ve davranış olarak da İslam hukukunun alanına girmektedir. Bu hususta da İslam hukukunda, toplumu ve aileyi koruma refleksiyle eşcinsel duyguların tavır ve davranış olarak ortaya konmasını kısıtlayıcı bazı tedbirler ortaya konmuştur. The concept of homosexuality, which in the past referred to sexual intercourse between homosexuals regardless of the person exhibiting homosexual behaviour, has now gained a broader conceptual content that includes the feelings, thoughts and behaviours of the homosexual individual. In this context, the aim of our study is to clarify the conceptual confusion about homosexuality to analyze the perception of homosexuality together with its transformation codes and to reach more accurate conclusions at the point of evaluating the concept of homosexuality in terms of Islamic law. In this thesis, it is aimed to evaluate the issue of homosexuality from a broader perspective by addressing the psychological, behavioral and social aspects of homosexuality without limiting the issue of homosexuality only to homosexual intercourse and the penal provisions regarding homosexual intercourse. In this way, it will be possible to offer more comprehensive and realistic solutions to the issue. In our research, first of all, homosexuality is defined with its conceptual content derived today and the meaning of this concept in Islamic law is revealed. A solution was sought from the perspective of Islamic law to the question of whether homosexuality is contrary to human nature or whether it is the human norm, which was put forward as a problem by some scientific circles in the fields of psychology and sociology in the modern period. In this context, the relationship between homosexuality and human nature has been analyzed and it has been concluded that homosexuality in terms of Islamic law is a condition that occurs later in human life under the influence of some psychological and sociological factors and is contrary to human nature. The ruling on homosexuality in terms of changing the human nature has been declared. Same-sex sexual partnerships are evaluated within the scope of Islamic criminal law as a social crime that negatively affects the family and generation like the crime of adultery. The penal provisions of the jurists on homosexual intercourse are discussed together with the evidence and the interpretations of the jurists, and a contribution is made to reach a correct judgment on this issue. Apart from this, homosexuality is also included in the field of Islamic law as a tendency, attitude and behavior. In this regard, Islamic law, with the reflex of protecting society and the family, has introduced some measures to restrict the manifestation of homosexual feelings as attitudes and behaviors.
