İş dünyasında üretim ve hizmet açısından çalışanlar önem taşımaktadır. Çalışanlar bazen bir işletmenin kimliği özelliğinde olabileceği gibi birtakım işletmeye özgü nitelikler barındırmaktadır. Söz konusu nitelikler işletmeler için önem taşındığı için makro düzeyde rekabetin korunması gerekmektedir. Rekabet yasağı, günümüzde farklı alanlarda kendini gösteren bir konudur. Rekabet yasağı iş hukuku alanında önem taşımaktadır. İşçi ve işverenin birbirlerine karşı borçları, hakları ve alacakları rekabet yasağı kapsamında değerlendirilmelidir. Çeşitli iş sözleşmeleri ile rekabet yasağının kapsamı ve uygulanabilirliği incelenmelidir. İşçinin rekabet etmeme borcu, işverene karşı iş sözleşmesi devam ederken yer alan yükümlülüğünü ifade eder. İş sözleşmesinin sona ermesi rekabet etmeme borcunu da sonlandırmaktadır. Ancak mevzuat hükümleri işverene bu konuda bazı farklı olanaklar sağlayabilmektedir. Bunun yanında rekabet etmeme borcunu sonlandırabilen farklı durumlar da mevcuttur. Tüm bunların ışığında rekabet etmeme borcuna aykırılıklar ve ilgili hukuki sürecin gerçekleşme şekline dikkat edilmesi gerekir. Since these qualities are important for businesses, competition at the macro level must be protected. Non-competition is an issue that manifests itself in different areas today. Non-competition is important in the field of labor law. The obligations, rights and receivables of the employee and the employer towards each other should be evaluated within the scope of the prohibition of competition. The scope and applicability of the non-competition clause in various employment contracts should be examined. The worker's duty of non-competition refers to his obligation towards the employer while the employment contract is ongoing. Termination of the employment contract also terminates the obligation of non-competition. However, legislative provisions may provide the employer with some different opportunities in this regard. In addition, there are different situations that can terminate the non-compete obligation. In light of all this, attention should be paid to violations of the obligation of non-competition and the manner in which the relevant legal process is carried out.
