Ceza muhakemesini başlatan şüphe, soruşturma evresi boyunca elde edilen deliller ışığında güçlenir ve yeterli yoğunluğa ulaşırsa, kovuşturma evresine geçilir. Kovuşturma evresinde amaç, şüphenin bertaraf edilmesi suretiyle yerini şüpheden arındırılmış maddi gerçekliğe bırakmasıdır. Ceza muhakemesi sürecinin merkezinde yer alan şüphe kavramı hem soruşturma hem de kovuşturma aşamasında tesis edilecek ceza muhakemesi işlemleri açısından son derece kritiktir. Ceza muhakemesinin usulüne uygun yürütülebilmesi ve mahkemece verilecek hükmün infaz edilebilmesini temin etmek amacıyla başvurulan koruma tedbirleri, bahse konu ceza muhakemesi işlemlerine örnektir. Şüphe kavramı ve koruma tedbirlerinin odak noktasına alındığı bu çalışmada birinci bölüm ile şüphe kavramının etimolojik incelemesi yapılmış ve kavramın diğer bilim dalları ve özellikle hukuktaki yeri vurgulanmıştır. Bunun yanı sıra ceza muhakemesi süreci ile şüphe ilişkisi detaylı bir şekilde incelenmiştir. İkinci bölümde ise ceza muhakemesinde koruma tedbirlerine odaklanılmış ve şüphe kavramının ceza muhakemesi hukuku koruma tedbirleri bakımından detaylı bir incelemesi yapılmıştır. If the suspicion that initiated the criminal procedure becomes stronger in light of the evidence obtained during the investigation phase and reaches sufficient intensity, the prosecution phase begins. In the prosecution phase, the aim is to eliminate the suspicion and give way to the factual truth free from doubt. The concept of suspicion, which is at the center of the judicial process, is extremely critical for the criminal procedures to be established at both the investigation and prosecution phases. Protection measures, which are applied to ensure that the criminal trial is carried out properly and the verdict given by the court is executable, are examples of these criminal procedures. This study focuses on the concept of suspicion and protection measures. The first part includes the etymological examination of the concept of suspicion and its value in the other branches of science and especially in law. In addition, the relationship between the criminal procedure process and suspicion is examined in detail. In the second part, the focus is on protection measures in criminal procedure and a detailed examination of the concept of suspicion in terms of protection measures in criminal procedure law is conducted.
