Bu tezin amacı 1982 Anayasası'nın getirdiği anayasal düzenin demokratik olup olmadığını ve ne ölçüde demokratik olduğunu incelemektir. Bu amaçla, siyaset bilimcilerin görüşlerinden yola çıkarak, demokrasinin temel ilkeleri araştırılmış ve bu ilkeler demokrasinin asgari şartları olarak kabul edilmiştir. Çalışma üç bölümden oluşmaktadır. İlk bölümde, demokrasinin temel ilkelleri belirlenmeye çalışılmış ve siyasal temsil, temel hakk ve gözgürlüklerin güvence altına alınması, eşitlik, siyasal çoğulculuk ve hukuk devleti olarak belirlenen bu ilkelerin kapsamlarının ne olması gerektiği araştırılmıştır. İkinci bölümde, Türkiye'nin 1980'e kadar geçirdiği demokratikleşme sürecine anayasal çerçevede kısaca değinilmiştir. Son bölümde ise birinci bölümde açıklanan demokrasinin temel ilkelerine dayanılarak 1982 Anayasası incelenmeye çalışılmıştır. |

The objective of this thesis is to examine whether the constititional order which 1982 Constitution had brought is democratic or not and what extant it is democratic. For this purpose, the study tries to find out the basic principles of democracy by making use of the views of political sciencists. These principles are assumed the minimum conditions of democracy. The study consists of three parts. In the first part, we try to find out basic principles of democracy. According to our findings, these principles are political representation, protection of basic rights and freedoms, equality, political pluralism and law state. In our thesis, we also discussed the meanings and concepts of these principles. In the second part, we study democratic process of Turkey until 1980 within its constitutional framework. In the final part, we analyze 1982 Constitution depending on the basic principles of democracy that we explain in the first part. |
