Bu tez çalışmasında, Türk Anayasal sisteminde cumhurbaşkanlığı kurumunun nasıl düzenlendiği, cumhurbaşkanının seçimi, görev ve sorumluluğuna ilişkin anayasal düzenlemelerin parlamenter sistemin gerekleriyle uyuşup uyuşmadığı irdelenmektedir. Bu nedenle çalışmada ilk olarak parlamenter hükümet sisteminde devlet başkanının rolü incelenmiştir. Daha sonra Türk Anayasalarında cumhurbaşkanının konumu ve yetkileri ile ilgili literatür çalışması yapılmıştır. Çalışma esas olarak cumhurbaşkanı ilgili tartışma ve önerilere odaklandığından, son bölümde de doktrindeki tartışma konusu olan hususlar ile değişiklik önerileri üzerinde durulmuştur. Çalışmada 1982 Anayasası'nda cumhurbaşkanının hukuki konumunun, parlamenter sisteme uygun olup olmadığı ortaya çıkarılmaya çalışılmıştır. Ana hatlarıyla çalışmanın sonunda, 1982 Anayasası'nın cumhurbaşkanına ilişkin hükümlerinin parlamenter sistemin gerekleri doğrultusunda değiştirilmesi kaçınılmaz olduğu sonucuna varılmıştır. In this thesis, how the presidency of the republic within Turkish constitutional system has been organized and whether the constitutional regulations concerning the election, duties and responsibilities of the president of the republic comply with the requirements of the parliamentary system are studied. To that end, in the first of place, the role of the head of state within the parliamentary government system has been analyzed in this study. Afterwards, the position and the powers of the president of the republic within Turkish constitutions have been discussed. As the study focuses primarily on the debates and proposals related to the president of the republic, the issues which are the subjects of debate in the doctrine as well as amendment proposals are emphasized in the last chapter. In this study, it has been investigated whether the legal position of the president of the republic in the Constitution of 1982 complies with the parliamentary system or not. As a result of the study, it has been concluded that the clauses in the Constitution of 1982 concerning the president of the republic should be amended in accordance with the requirements of the parliamentary system.
