Devletin yerel yönetimler eliyle yürüttüğü hizmetleri üstlenmesinin; hem hizmetlerin kalitesinde, hem yapılma hızında büyük kayıplara neden olduğu bilinmektedir. Bu bağlamda gerekli denetim mekanizmalarını, yerel özerklik anlayışına zarar vermeden oluşturarak, yerel yönetimleri güçlendirmeye çalışmak gerekmektedir. Bu tez çalışması, yerel yönetimlerde idari vesayet yetkisi ve özerklik ilişkisinin Türkiye üzerindeki yansımalarını belirlemek amacıyla yapılmıştır. Bu nedenle çalışma kapsamında denetim ve özerklik kavramları ile idari vesayet denetiminin özerklik üzerindeki etkisine bakılmış, zaman zaman eski ve yeni mevzuatın karşılaştırılarak merkezi idarenin yerel yönetimlerin kararları üzerindeki denetim yetkileri de incelenmiştir. İdari vesayet ve özerklik ilişkisi yerel hizmetlerde yerellik ilkesi ve yerel hizmetler açısından değerlendirilirken, siyasal özerklik açıdan ele alınmamıştır. Ayrıca, bu kapsamın içerisinde Büyükşehir Belediyeleri ile köylere ilişkin ayrıntılı inceleme yapılmamıştır. Çalışma, üç bölümden oluşmaktadır. Birinci bölümde özerklik, denetim ve vesayet denetimi kavramlarının genel çerçevesi değerlendirilmiştir. İkinci bölümde, Türkiye'de ve bazı ülkelerde yerel yönetimler ve özerklik ilişkisi irdelenmiştir. Son olarak çalışmanın üçüncü bölümünde, Türkiye'de yerel yönetimlerin vesayet denetimi ve yerel özerklik üzerinde etkisine yer verilmiştir. Bu çerçevede idari vesayet yetkisini kullanan yetkili makamlar ve üzerinde idari vesayet yetkisi uygulanan yerel yönetim birimlerinden bahsedilirken, İl Özel İdareleri ve Belediyeler incelenmiştir. Sonuç olarak, vesayet denetimi ile özerklik kavramı beraber değerlendirildiğinde bazı durumlarda birbirleriyle bağdaşmadığı görülmektedir. Bu nedenle ülkemizde merkezi yönetimin yerel yönetimler üzerindeki idari vesayet yetkisini kullanırken zaman zaman yerel özerklik ilişkisini zedelediği görülmektedir. It has been know that undertaking the services which the government have executed itself via the local administrations has been causing to a great loss both in the providing rate of services and their qalitiy . in this context it is reqired to strengthen the local administrations forming the neeessary government mechanisms without giving damage to the concept of the local autonomy. This thesis study has been done in order to determine the reflects of the reflects of the relationship authority of tutelage and autonomy in the local administrations on Turkey. Therefore, the effect of the concepts supervision and autonomy and administrative tutelage supervision on the autonomy has been investigated and the supervision authorities on the decisions of the central administration and local administrations have been taken into consideration comparing the previous and the present laws time to time though this study as well. Whereas the relationship of administrative tutelage and autonomy has been rating in local services in view of the localization principle and local services, it hasn't been evaluated in view of the political autonomy. Furtermore, no further investigation about the metropolition municipalities and the villages has been done in this context. The present study is divided into three parts. in the fırst part, the autonomy has been evaluated within its general frame as the relationship between the local administrations and the autonomy in Turkey and in some countries has been searehed. Finally, in the third part of this study, the effect on the local autonomy and the tutolage supervision of the local admistrations in Turkey has been mantioned. in this frame, Special Provincial Administrations and municipalities have been investigated whereas the competent authority which uses their tutolage supervision and the local administrative tutolage authority have been mentioned. As a result it has seen that they have not got along with each other in many views when the tutolage supervision and the concept of autonomy have been exaluated together. Fort that reason, we see that this gives harm to the local autonomy relationship time to time while the central administration is using the authority of the administrative tutolage on the local administrations.
