Bu tezin amacı, devlet yardımlarının ülkemiz açısından Avrupa Birliği'ne giriş sürecin de öneminin belirlenmesi ve kontrolsüz verilen yardımların rekabet ve haksız rekabet açısından piyasaları nasıl etkilediğini göstermektir. Çalışmanın aşamaları aşağıdaki gibi oluşmuştur; İlk olarak; bu bölümde devlet yardımlarının tarihi gelişimi, devlet yardımlarının amacı, çeşitleri, çerçevesi, AB ile ilgili yükümlülükler; devlet yardımları sisteminin değerlendirilmesi, ülkemizdeki işleyişi Türkiye'nin AB müktesebatına uyum sürecindeki rolü konuları incelenmiştir. İkinci bölümde ise; devlet yardımları ve rekabet hukuku ilişkisi irdelenmiştir. Ülke ekonomilerinin birbirleri ile uyum ve rekabet sorununu ortaya çıkarmıştır rekabetin yararları, rekabeti sınırlayıcı anlaşma, uyumlu eylem ve kararlar ile hakim durumun kötüye kullanılması halleri ve muafiyet kavramı üzerin de durulmuştur. Bu anlamda devlet yardımları RK 4., 6. ve 7. maddeleri kapsamında ilgili piyasadaki rekabet düzenine etkisi tartışılmıştır. Bu bölümde son olarak devlet yardımlarının serbest rekabet hakkına etkisi rekabet hukuku kapsamında ele alınarak incelenmiştir. Son bölümde; devlet yardımları kanun tasarısının amacı, yardım verilirken gerekli usul ve esaslar ile tasarının getirdiği yenilikler burada belirtilmiş ve AB üyeliğine aday bir ülke olarak Türkiye, devlet yardımları mevzuatını AB'nin devlet yardımları mevzuatıyla uyumlaştırması hedeflenmektedir. Bunun için Türkiye, Ulusal Programın da belirtilen kapsamındaki devlet yardımları ile ilgili yükümlülüklerini kısa ve orta vadede yerine getirilmesi üzerinde durulmuştur. The purpose of this thesis, is that setting the importance of state aids in the process of aiming membership of European Union and to show how uncontrolled aids affect markets in terms of competition and unfair competition. Phases of the study are as follows; Firstly; in this section The historical development of governmental assistances, The purpose of state aids, types, the framework of governmental assistances, European Union-related obligations and assessment of governmental assistances system and the process of state aids in our country, Turkey's compliance with legislation of EU integration process are emphasized. In the second part also; the relationship of state aids and competition law is explicated. It reveals the competition problem and harmony with each other, ıt is emphasized on the benefits of competition, the agreement which limits the competition with concerted action and decisions abuse of dominint position, the concept of exemption. As such the influence of state aids on competition situation the provisions of the articles RK4,6 and 7 is debated.In this section lastly the influence of state aids on the right of free competition is analysed with in the context of competition law. In the last section; the purpose of governmental assistances bill, necessary rules and procedures followed while giving the governmental assistances and innovations of the draft are listed and Turkey, as a candidate country for EU membership, harmonization governmental assistances legislation with EU legislation are aimed at. For this reason ıt is emphasized on Turkey must fulfill its obligations in the short and medium term stated that under the National Program.
