Bu tezin amacı, 657 Sayılı Yasa'nın 4/B maddesi çerçevesinde istihdam edilen sözleşmeli personelin durumunu, sıkıntıları ve görüşlerini ortaya koymaktır. Bu doğrultuda, araştırma yöntemi olarak "nitel araştırma yöntemi" seçilmiş, veri toplama aracı olarak ise anket tekniği kullanılmıştır. Hazırlanan anket 193 kişiyle yüz yüze görüşülerek uygulanmış ve elde veriler SPSS 15.0 istatistik programı kullanılarak analiz edilmiştir. Çalışmamızın birinci bölümünde, Türk kamu personel sisteminin genel özellikleri, eleştirilen yönleri ve sorunlarına değinilmiştir. İkinci bölümde ise, kamu personel sistemindeki değişim ve yeniden yapılandırma çalışmaları yer almaktadır. Üçüncü bölümde, sözleşmeli personel istidam biçimleri ve sözleşmeli personel istihdamının ana gövdesini oluşturan 657 Sayılı Yasa'nın 4/B maddesi çerçevesindeki istihdamın sorun alanlarına yer verilmiştir. Son bölümde ise, Akdeniz Üniversitesi'nde 657 Sayılı Yasa'nın 4/B maddesi çerçevesinde çalışan sözleşmeli personelin durumları, sıkıntıları ve görüşleri ortaya konulmaya çalışılmıştır. Çalışmamız bütün olarak değerlendirildiğinde ortaya çıkan sonucu şu şekilde özetleyebiliriz; sözleşmeli personel uygulamasının bugün geldiği nokta, kamu personel sistemindeki "eşitsizliği" arttırarak derinleştirmektedir. Bu durum kamu personeli arasında huzursuzluğa neden olarak, çalışanların motivasyonunu, takım çalışmasını, iş verimini olumsuz yönde etkilemektedir. Bu durum kamu personel sitemindeki bütünlüğü de zedelemektedir. Bu olumsuz durumların ortadan kaldırılabilmesi için, kamu personel sisteminde bütünlüğün, liyakatin, adaletin ve eşitliğin esas alındığı kapsamlı bir yeniden düzenlemeye ihtiyaç vardır. The purpose of this thesis is to point to the issues, the opinions and the situational conditions of the contract employee employed within the scope of the article 4/B of Law Number 657. By such means, the research method has been chosen as .the qualitative research method. and the survey technique was applied to gather data related to the study. The survey prepared was applied to 193 people who were interviewed face to face and the data gathered was analyzed by the statistical program SPSS 15.0. In the first part of our study, the general features of the public employee system were subjected to with its criticized aspects and issues. As in the second part of the study, the subject was directed to the changes in the public employee system and the reconstruction studies that were applied to. In the third part, the ways of which contract employees are employed and the problematic areas issued in the employment of contract employees within the scope of the article 4/B of Law Number 657. In the conclusion, the study has tried to focus on the situations, issues and opinions that are raised for the contract employee employed within the scope of the article 4/B of Law Number 657 at Akdeniz University. When our study and research is assessed as a whole we can simply summarize the results gained as: the point that the applications of contract employees has come to at present is deepening the inequalities of the system and that such a situation causes disorders among all public employees and causes negative impact in the motivation of the staff, the team work and productivity in the field. Such situation also causes a negative impact on the whole public employee system leading to disorders. For the removal of such negative issues, the system requires an innovation and reconstruction that considers the whole of the public employee system regarding the qualification, the justice and the aspects of equity of the system.
