Bu çalışmada 21/01/2010 tarihli 5947 sayılı kanun ile hukuk sistemimize giren hekimlik zorunlu mali sorumluluk sigortası incelenmiştir.Çalışmada hekimlik zorunlu mali sorumluluk sigortasının yapılması, devam etmesi, sona ermesi durumları anlatılmıştır. Özellikle sigortanın sağladığı himayenin sınırları, hangi durumları güvence altına aldığı ve hangi durumları güvence dışında tuttuğu detaylı olarak tespit edilmeye çalışılmıştır.Çalışmanın bir diğer amacı ise hekimlik zorunlu mali sorumluluk sigortası ile ilgili mevzuattaki eksiklikleri ortaya çıkarmak ve bunlara uygun çözüm önerileri getirmektir. Bu doğrultuda sigorta hukuku tekniğine uygun olarak çalışmada eleştiriler yapılmıştır.Bu çalışma ile hekimlik zorunlu mali sorumluluk sigortasının anlaşılması ve daha iyi bir sistemin oluşturulması için yapılması gerekenlerin tespit edilmesi amaçlanmıştır. In this work, Doctor's obligatory malpractice insurance was studied which entered into vigor with the Law numbered 5947 and dated 21/01/2010.The continuation and termination of this insurance contract was discussed . Especially the limitation of the content provided by the insurance; in which situation the coverage exists or does not exist were particulary aimed to be analiysed.On the other hand this work aims to explain the lacks in the law of the medical obligatory insurance and to find advisory solutions. For that purpose, the ciritcs are made in accordance with the insurance law.This work, aims to explain the medicialobligatory insurance and to fix the must-do to develop a better system.
