Sigortacı ile acente arasında akdedilen acentelik sözleşmesi doğrultusunda, acentenin sahip olduğu temsil yetkisi bu çalışmanın esasını oluşturmaktadır. Çalışmada üçüncü kişilere karşı sigortacının temsilcisi sıfatıyla faaliyet gösteren acentenin kullandığı yetkiler tanımlanarak, bu yetkilerin kapsam ve sınırları belirlenmeye çalışılmış ve yine bu yetkilerin kaldırılması ve sınırlandırılması üzerinde durulmuştur. Belirtilen hususlar ele alınırken, Yargıtay içtihatlarından yola çıkılarak, uygulamada sıkça karşılaşılan sorunlar tespit edilmeye çalışılmış ve özellikle kanunda açıklık bulunmayan ve doktrinde de tartışmalı bulunan konulara değinilerek, sigorta acentesinin temsil yetkisi kavramının ortaya konulması amaçlanmıştır.Türk Ticaret Kanunu ve Sigortacılık Kanunu Hükümleri Işığında Sigorta Acentesinin Temsil Yetkisi adlı tez çalışması üç bölümden oluşmaktadır. İlk bölümde TTK'da geçen genel acentelik müessesesi ile acentelik sözleşmesinden kaynaklanan hak ve yükümlülükler, sigorta acentesinin temsil yetkisi ile ilişkilendirilmek suretiyle açıklanmaya çalışılmıştır.Sigorta acentesi, gerek aracı gerekse akitçi acente sıfatını haiz olsun, her durumda üçüncü kişilerle akdedilen sigorta sözleşmesinin öncesinde, devamında ve sona ermesinden sonraki aşamalarda farklı yetkilere sahip olduğu için, bu yetkiler de kapsamlı şekilde ikinci bölümde ayrıca incelenmiştir.Sigorta acentesinin temsil yetkisinin sınırlarının çizilmesi, sigorta sözleşmesinde tarafların haklarının korunması bakımından oldukça önemlidir. Bu nedenle üçüncü bölümde, sigorta acentesinin temsil yetkisinin sınırlandırılması, kaldırılması ve acentelik sözleşmesinin sona ermesiyle birlikte acentenin temsil yetkisinin kendiliğinden son bulması hususları ele alınmıştır. This study is based on the representative authority of the agent, in accordance with the agent agreement signed between the Agent and the Insurer. In this study, agent‟s powers as the insurer‟s representative against the third parties are defined and the scope and limit of these authorities are tried to be specified, by emphasizing the removal and restriction of these authorities. As long of while discussing these subjects from Supreme Court practices, problems faced frequently in the daily practice are tried to be identified and especially adverted on the legal gaps in the Code and the controversial points in the Doctrine in order to put forward the representative authority of the insurance Agent.This thesis study named “Representative Authority of the Insurance Agent in consideration of the Turkish Commercial Code and Code of Insurance” consists of three sections. In the first section general agent concept in Turkish Commercial Code and its rights and obligations arising from the Agent Agreement are tried to be explained in association with the representative authority of the insurance agent.Therefore the insurance agent, either intermediary or authorized to make agreements, have different authorities in different stages such as before the insurance Agreement signed with third parties, later on and even after the agreement is done. These authorities are evaluated extensively in the second section.Drawing the lines of the representative authority of the insurance agent is important for protecting the rights of the parties of the insurance Agreement. For this reason in the third section the restriction, the removal of the representative authority of the insurance agent‟s and expiration of the agent agreement on its own motion are discussed.
