Bu çalışmanın konusunu, uluslararası sözleşmelerde ve Türk Hukukunda evlenme ve aile kurma hakkı oluşturmaktadır. Bu hak, toplumsal değişimlerden etkilenmeye oldukça müsaittir. Bu etkileşimin hukuk zeminindeki boyutlarının ortaya konulabilmesi için, öncelikle evlenme ve aile kurma hakkının uluslararası belgelerde ve karşılaştırmalı hukukta nasıl düzenlendiği incelenmiştir. Çalışma kapsamında, Avrupa İnsan Hakları Sözleşmesine detaylı bir şekilde yer verilmiştir. Sözleşmenin 12. maddesinde yer alan hakkın kapsamı ve uygulanmasının tespitinde Avrupa İnsan Hakları Mahkemesi kararları irdelenmiştir. Çalışmanın son bölümünde, Türk Hukukunda evlenme ve aile kurma hakkına ilişkin düzenlemelere yer verilerek, bu düzenlemelerin Avrupa İnsan Hakları Sözleşmesinin 12. maddesi ve Avrupa İnsan Hakları Mahkemesinin içtihatları karşısındaki konumu değerlendirilmiştir. Tezde, evlenme ve aile kurma hakkının her geçen gün öneminin arttığı, uygulamada yargı organlarının önüne daha sık gelmeye başladığı, özellikle Avrupa ülkelerinde olmak üzere evlenme ve aile hayatıyla ilgili gelişmelerin, hukuksal alanda yeni düzenlemeler yapılmasına ve yargısal içtihatlarda değişikliğe gidilmesine yol açtığı sonucuna ulaşılmıştır. The right to marry and found a family in international instruments and Turkish Law, comprises the subject of this study. This right is quite convenient to be affected by social changes. It is firstly scrutinised that how the right to marry and found a family drew up in the international instruments and comparative law to assert the aspects of this interaction in the area of law. Within the scope of this study, it is worked through the European Convention on Human Rights. To confirm the scope and exercising of the right under article 12 of the Convention, desicions of European Court of Human Rights has been examined. In the last part of the study, it is included that the legal arrangements about the right to marry and found a family in Turkish Law. Then it was assessed that whether these arrengements are compatible with the article 12 of the Convention and the desicions of the Court.In this study, it is concluded that; the importance of the right to marry and found a family has been increasing and this right became more actionable. It is also concluded that developments concerning marriage and family life caused making new legal regulations and changes in case laws especially in European Countries.
