'İslam Hukukunda Yardımcı Üreme Teknikleri ve Taşıyıcı Annelik' adlı bu çalışma, giriş ve üç bölümden oluşmaktadır. Girişte araştırmanın konusu, önemi, amacı ve kaynaklarına ilişkin bilgiler yer almaktadır. Burada, yardımcı üreme teknikleri ve taşıyıcı anneliğin mahiyetinden bahsedilmekte, bu çalışmayla neyin hedeflendiği ve hangi kaynaklara başvurulduğu belirtilmektedir. Birinci bölüm; yardımcı üreme tekniklerine tahsis edilmiştir. Bu bölümde öncelikle yardımcı üreme tekniklerine başvurmayı gerektiren infertilite, sterilite ve bunların sebepleri üzerinde durulmaktadır. Sonrasında bu tekniklerin tarihçesi ve söz konusu tekniklere ilişkin etik tartışmalar ile bunların çeşitleri incelenmiştir. Bölüm, uygulamanın İslam hukukundaki yaklaşımlarına yer vererek sonlandırılmıştır. İkinci bölümde taşıyıcı annelik; tanım, tarihçe, çeşitleri ve başvurulma nedenleri bağlamında incelenmiş ve taşıyıcı anneliğe etik, psikolojik ve sosyolojik açılardan yöneltilen eleştirilere yer verilmiştir. Çalışmanın üçüncü bölümünde taşıyıcı anneliğin hukuki boyutu Sünnî ve Şiî yaklaşımlar ekseninde ele alınmış, uygulamanın maslahata uygun olup olmadığı taşıyıcı anneliğe dahil olan bütün taraflar açısından değerlendirilmiş ve konu nesep, velayet ve kira akdi gibi hususlar çerçevesinde işlenmiştir. This study which is called "Assisted Reproductive Techniques and Surrogate Motherhood in Islamic Law" consists of an introduction and three chapters. In introduction, information related to subject of the research and its significance, purpose and resources are taken part in. In this chapter, nature of assisted reproductive techniques and surrogacy, aim of this study and reference resources are stated.The first section was allocated to assisted reproductive techniques. Firstly, infertility and sterility that require assisted reproductive techniques and their causes are discussed. After that the history of these techniques and ethical debates related to these techniques and their varieties were investigated. The section was completed by mentioning approaches that are in Islamic Law.In the second section surrogacy were examined in the context of definition, historical background, types and the reasons of applying. Criticisms that are against surrogacy are given place in ethical, psychological and sociological aspects.In the third section of the study the legal aspect of surrogacy was discussed in the context of approaches in Sunni and Shi’i. Application’s affair was evaluated for all parties which involved in surrogacy. The subject was processed in the framework of matters such as lineage, child custody and rental contract.
